Consultancy Services - Safeguards Specialist (?IC-C-009)
Ukraine has received financing from theInternational Bank forReconstruction and Development (IBRD) in the amount US$ 350 million under IBRDrelated Loan Agreement No.8391-UA (US$ 300 million) and CTF related LoanAgreement ?TF017112 (US$ 50 million) toward the cost of Second UrbanInfrastructure Project (hereinafter ? the Project). The Project includes threecomponents: ?) Urban Infrastructure Investment; ?) Institutional Strengtheningand Capacity Building; ?) Project Management and seeks to assist UtilityCompanies of selected cities to improve quality and reliability of the serviceswhile decreasing their costs through a series of institutional improvements andselective investments in reconstruction and replacement of deteriorated watersupply and sanitation systems and solid waste management systems.
The Project will be implemented under generalsupervision of MinistryofRegional Development, Construction and Housing and Communal Services of Ukraine(hereinafter ? Minregion). Minregion created a Central Project Management Unit(hereinafter ? CPMU) for day-to-day management and coordination of the Projectand provision of assistance to Utility Companies participating in theProjectin disbursement issues, financial management, reporting and other Projectrelated activities. CPMU shall be responsible for general coordination ofactivities and reporting under the Project.
Implementation of the Project shall beregulated by the Decree No.1027of the Cabinet of Ministers of Ukraine "On the Procedure of Initiation,Preparation and Implementation of Projects of Economic and Social Developmentof Ukraine Supported by International Financial Organization" dated 26.11.2008,other legal acts of the Cabinet of Ministers of Ukraine, orders of Minregionand Project Operations Manual.
SafeguardsSpecialist shall make arrangements to ?) initiate andconduct preliminary project-level Social and Environmental Impact Assessmentsandidentify jointly with utility specialists and regional PIUs potentialimpactsthat may be caused by Project related activities and determine necessarymitigating actions to be incorporated in the site-specific Environmental andSocial Management Plan (ESMP), and ??) monitor on a regular basis social and environmentaleffects caused by activities financed under the Project and compliance with therequirements of the ESMP.
III. SCOPE OFSERVICES
Safeguards Specialist will perform the following tasks:
(a) provision ofsupport to the Project on safeguards policy requirements and issues related toproject implementation;
(b) analysis of subprojects, identification of potential environmental effectsof selected subprojects and ecological category of subprojects and type ofrequired EIA documents;
(c) provision of assistance to sub-project proponents in preparation ofESMP;
(d) ensure compliance of environmental and social assessment conducted undereach sub-project to the World Bank policies; in those cases when requirementsof the World Bank are superior to the national legislation of Ukraine, theformer should be observed;
(e) ensure, prior to commencement of works, availability of all necessarypermits to take any actions to perform such works as designed;
(f) ensure availability of necessary documentation (Environmental ImpactAssessment Report and/or ESMP) for each selected sub-project;
(g) ensure due consideration of all requiredmonitoring and mitigating actionsin financial plans of the sub-projects;
(h) provision to Contractors of full list ofmandatory environmental and socialimpact requirements to be fulfilled prior to commencement of implementation ofrespective sub-projects;
(i) checking of bids for compliance with environmental and social safeguard requirementsand identification of gaps not covered by mitigating actions;
(j) preparation of environmental clauses to be included in contracts forimplementation of selected sub-projects;
(k) monitoring of proper organization of public hearings under each sub-projectand public access to results of such hearings;
(l) supervision of implementation of mitigating actions identified in ESMP ineach sub-project and informing Minregion about any recorded breaches;
(m) ensure implementation of a monitoring plan by each sub-project, includingidentification of baseline indicators and efficiency of mitigating actions;
(n) preparation of semi-annual reports on implementation of actions included inESMP of selected sub-projects;
(o) preparation of semi-annual reports on environmental and social impacts thatemerged during implementation of sub-projects and analysis of efficiency ofmitigating action take to minimize the negative effects;
(p) preparation of reporting recommendationsand requirements for contractorsto properly report on progress in implementation of environmental andsocialmeasures, monitoring plans, and analysis of submitted reports;
(q) participation in public presentation of results obtained after implementationof mitigating actions take during reconstruction/rehabilitation works;
(r) monitoring of issues relating to land acquisition and any potentialresettlements necessitated by implementation of the subprojects; ensurepreparation and utilization of corresponding resettlement instrumentsprior tocommencement of the works which require acquisition of land;
(s) monitoring of complaints received duringthe period of Projectimplementation through a grieving and compensation system, review of complaintsby CPMU or, if required, Bank, if not resolved at RPMU level;
(t) preparation of citizen engagement and beneficiary feedback mechanisms andmonitoring systems;
(u) performance of otherassignments as required under the Project.
IV. SafeguardsSpecialist provides the services directly in theMinregion premises. REPORTING
SafeguardsSpecialist will report to Head of CPMU. SafeguardsSpecialist isrequired to complete monthly time sheets to identify the time spent. The Head of theCPMU may request submission of supporting draft documents, documents etc.,which the Consultant prepares and works on during the assignment.

VI. REQUIRED EDUCATION ANDQUALIFICATIONS
? Universitydegree in environment protection (ecology) or construction engineering;
? Provenpractical experience of preparation of Environmental Impact Assessment (EIA) andsocial impact assessments at least 3 years. Previous work with EIA forconstruction projects will be an advantage;
? Knowledgeof national environmental regulatory requirements regarding EIA and IBRD environmentalsafeguard policies;
? FluentEnglish, and in Ukrainian language, including knowledge of technical andenvironmental and social impact terminology relating to the Project;
? Experienceof environmental support (protection of environment) in projects ofinternational agencies, international financial and donor organizations willprovide an advantage;
? Advancedlevel of PC skills, knowledge and practical skills of using standard MSpackages (MS Word, Excel, Power Point), email and databases;
? Experienceworking on the social impacts (including gender, citizen engagement/beneficiaryfeedback) of development projects, preferably infrastructure projects.
? Strongcommunication skills with both government partners and communities (rural andurban).Experience working in a variety of sectoral contexts (e.g. energy,transport) in both project design and implementation.
? Priorexperience working with multilaterals on the application of safeguardpolicies/performance standards will be an advantage.
VII. PLACE, DURATION ANDREMUNERATION
The services shallbe provided in the city ofKyiv until October 31, 2020 with possibility of extension. The services will beprovided on a full-time basis.
