Balancing is understood to cover the losses resulting from the difference in energy consumption forecast against the real one over a given settlement period.The Contractor shall release the Purchaser from all costs and obligations related to commercial balancing and to prepare and report the schedules of electricity demand to the Distribution System Operator and Transmission System Operator. The Contractor is obliged to provide the Purchaser with quality standards of service and delivered energy in accordance with the binding provisions of the Energy Law and its implementing regulations. The Contractor shall not be liable for failing to supply electricity to the Purchaser's premises in case of natural disasters, other cases of force majeure, system failures and network failures, as well as due to exclusions made by the DSO. The Contractor is obliged to grant a discount in the amount specified in the abovementioned. regulations. The Contractor must have a contract concluded (valid during the execution of this contract) or a promise of conclusion of the contract (on the day of entering into force of the contract of sale of electricity between the Contractor and the Purchaser) with the relevant DSOs operating on electricity distribution points. DSO to power points specified in Annexes 2a-g and 2h-i to the Agreement. The contractor will be obliged to sign separate contracts with the municipality of Stare Babice, with each commune budget unit and Commune Municipal Enterprise EKO - BABICE Sp. z oo indicated in Appendix 2 to the Agreement. Detailed description including List of objects, PPE data, estimated electricity demand for individual objects in the period from 1.1.2018 to 31.12.2019 is included in the Annexes 2 ag and 2 h to the Agreement. 8th March 6, for which a 3 month notice period applies. New contracts for the sale of electricity to the facilities listed in Annexes 2 ag and 2 and hi to the Contractor Contract will be entered into.
