Closure and recultivation of the existing dumpsite

This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD website, Procurement Notices (www.ebrd.com) on October 14, 2014.

Municipal Enterprise “Bishkek Sanitary Landfill” for and on behalf of Bishkek City Administration, Kyrgyz Republic hereinafter referred to as “the Employer”, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) and of a Grant from the Investment Facility for Central Asia of the European Union EU IFCA (the Grant) towards the cost of Bishkek Solid Waste Project.

The Employer now invites sealed tenders from contractors for the following contract (s) to be funded from part of the proceeds of the loan and the grant:

Closure and recultivation of the existing dumpsite, approx. area 36 ha

Tendering for the contract to be financed with the proceeds of the loan from the Bank and the Grant is open to firms from any country.

To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

  1. General criteria

Joint ventures

Participation of joint ventures and consortia is allowed. A company nominated to be the leader of a joint venture or a consortium (hereinafter the Leader) shall have not less than 60 % of the qualifying criteria; the other members (hereinafter the Partners) shall have not less than 25% of the qualification criteria. The joint venture must satisfy collectively all the qualifying criteria. The relevant figures for each of the partners shall be added to arrive at the joint venture's total capacity. Individual members of the joint venture must each satisfy the requirements for financial reports and litigation.

  1. General Experience. The Tenderer shall have an average annual turnover (defined as annual turnover calculated in a hard currency equivalent) as a contractor over the last 5 years of not less than equivalent of 3 million EUR per year.
     
  2. Specific experience. The Tenderer shall have experience of successful implementation of at least 3 (three) contracts of a nature and complexity comparable to the proposed contract in the capacity of a general contractor, and has the following specific experience within the last 5 (five) years: 

 

Experience of construction

  1. Recultivation of at least 3 (three) dumpsites, including at least one to be at least 30 hectares in area and at least two to include construction of impervious layer and construction of a gas collection and release system.
  2. Construction experience gained in similar climatic conditions (from +30oC to -30oC).

AND

Design experience   

  1. Designing of at least 2 (two) dumpsites recultivation, including at least one of an area of minimum 30 hectares, and at least one to include construction of impervious layer and construction of a gas collection and release system, with a volume of waste disposal not less than 2.5 million tons with carrying out detailed experimental research on geology, hydrogeology, environmental impact study, and on the volume and quality of generated landfill gas.
  2. Designing experience gained in similar climatic conditions (from +30oC to -30oC).

 

  1. Personnel Capabilities

Construction Management Team   

  • Project Manager – 10 years general experience and 5 years of experience in managing infrastructure projects and construction contracts in accordance with FIDIC contract conditions;
  • Site Manager – 10 years general experience and 5 years of experience in construction and/or recultivation of dumpsites/landfills;

Design Team:

  • Chief Engineer – 10 years of experience in design works;
  • Waste management/landfill gas expert – 10 years of experience in design works;
  • Geologic engineer – 5 years of experience in design works;
  • Hydrogeologist – 5 years of experience in design works;
  • Environmental specialist – 5 years of experience in similar works;

 

For each position the Tenderer shall provide information in a form given in the Tender Documents, Section IV, Tender Forms.

  1. Financial position. The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 4 (four) months, estimated as not less than EUR 450,000 (Four hundred fifty thousand) equivalent, taking into account the applicant's commitments for other contracts.

    The audited Balance Sheets and Profit and Loss Statements for the last 5 (five) years starting 2011 shall be submitted and must demonstrate the soundness of the Tenderer’s financial position, showing long-term profitability.  Where necessary, the Employer will make inquiries with the Tenderer's bankers. Should the tenderers owned by individuals or partnerships not be required to maintain audited balance sheets by the laws of their countries of origin, this audit requirement does not apply.
     
  2. Litigation History. The Tenderer should have a Litigation History without major claims. A consistent history of awards against the Tenderer or any partner of a joint venture may result in failure of the application. The Tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last 5 five years. The Employer reserves the right to exclude tenderers which have a litigation history showing more than two cases during the last five years where the award was against the tenderer.
     
  3. Other criteria. The Tenderer shall demonstrate it is able to meet the requirements of Kyrgyz legislation. These include but are not limited to construction license, design license or availability of certified designers. If such licenses and certificates are available at the time of the tender submission, their copies shall be provided. Otherwise, the Tenderer must clearly state that all required licenses will be submitted within 42 days after the contract award.
    The goods, materials, works and equipment under this Tender Document shall be designed, manufactured and supplied in accordance with the appropriate Kyrgyz laws, codes and regulations or they shall conform to the respective European and international standards, and quality certificate ISO 9001 or equivalent. In case of discrepancies between state and international standards, the preference shall be given to the standards with more strict requirements.

Assignment Description:
 
The City of Bishkek is working with the EBRD to improve its municipal solid waste (MSW) management system. The current system suffers from underinvestment in both infrastructure and vehicles and lacks any formal recycling functions. Although the current system is functioning and the waste is collected and transported from the City to the municipal disposal site, part of the vehicle fleet is old and suffers from frequent breakdowns. In addition, the disposal site needs rehabilitation and a new sanitary landfill will be built.
 
The existing site has been in operation since 1979 and lacks any artificial lining, gas collection system and cover while leachate periodically overflows to a nearby river basin. There is a large number of informal waste pickers working at the landfill and illegal settlements have been built next to the site. The bulk of MSW collection is carried out by a single municipal company, Tazalyk, which collects solid waste from containers in multi-storey areas and directly from residents in private housing areas. Tazalyk is also responsible for street cleaning activities. Fees for solid waste collection and disposal are collected by another municipal entity, the Center of Communal Payments. Both entities report to the Housing, Maintenance and Utilities department of the Mayor’s Office (the HMU) which in turn reports to the vice-mayor.
 
The City, via a Project Implementation Unit (PIU), will manage the procurement and implementation. The City will be the Consultant’s client and will have overall responsibility for the Project. The Consultant’s role will be to act as an adviser but will also provide strong day-to-day Project management input and full engineering and design services to ensure that the Project is implemented efficiently, in accordance with international best-practice and on time. The Consultant will support both Tazalyk and the Landfill operator in implementing the planned investments.
 
The Project will include the following components: (i) a stepwise recultivation of the existing municipal disposal site in parallel with the construction of a new sanitary landfill on the adjacent area. Part of the old waste will be moved from the protection zone of the nearby gas transit pipeline and used to reprofile the existing site. A surface lining system with gas collection will be installed on the recultivated site. The new landfill area would comprise a gas extraction and flaring system, leachate collection and evaporation system; weighbridge; building for personnel, mobile equipment (1 compactor, 1 bulldozer, 1 wheel loader), reservoirs for fire extinguishing, asphalting of access and internal roads. The new landfill will consist of two parts. Part 1 is expected to last until 2026 by which time Part 2 will have to be commissioned (to the north of Part 1). During the recultivation and construction works the operation of the existing dumpsite will be significantly improved; (ii) the entrance area of the landfill will comprise a combined front-end facility with material recovery (MRF) and mechanical-biological treatment (MBT) functions. Incoming waste would be fed to the combined MRF/MBT facility and only rejects will be disposed of at the landfill; (iii) rehabilitation of existing waste collection points by repairing/building containments and replacing damaged containers; (iv) extension of containerized collection to private housing areas by placing bulky containers at sparsely populated areas without paved roads and building new collection points with euro containers in more densely populated areas that have paved roads; (v) introduction of separate collection of paper and plastic at educational institutions; (vi) organizing separate collection rounds for medical waste at healthcare organizations; (vii) extension of composting activities by enlarging the current composting site and building a new site in the southern parts of the city; (viii) implementation of GPS monitoring of waste collection trucks; and (ix) implementation of route optimization of collection vehicles.
 
The PIU was established and staffed in the third quarter of 2014 to work with the originally contracted PIU Consultant with whom the contract was terminated in November 2014. The PIU has day-to-day responsibility for the assets to be financed via the Project. There will also be a Steering Committee comprising representatives from the City and other relevant stakeholders. The City will have the ultimate responsibility for the Project as the owner and operator of the financed assets. The PIU and Steering Committee will function during the implementation of the Project.
 
The overall objective of the assignment is to facilitate the timely and effective implementation of the Project by rendering assistance to the City in all aspects of Project implementation, including day-to-day support for project management input, full engineering and design services, as well as procurement and disbursement.
 
The Consultant shall perform the following main tasks: (i) overall Project management support; (ii) procurement; (iii) disbursement; and (iv) Technical supervision.
 
The Consultant shall take over the Project implementation at a stage where the goods and works procurement in relation to waste collection has been completed and landfill tender on a design and build basis has been published. 
 
The overall Project implementation is divided in two stages: Stage I – detailed design and tendering, and Stage II – contract monitoring and supervision.
 
Status of Selection Process: Interested firms or group of firms are hereby invited to submit expressions of interest.
 
Assignment Start Date and Duration: The Assignment is expected to start in autumn 2015 and has an estimated overall duration of 36 months.
 
Maximum Budget available for the Assignment: EUR 675,000 (exclusive of VAT. The Consultant must determine whether any indirect taxes/VAT are chargeable on the proposed services and state the basis for such. If any indirect taxes/VAT are payable, the Client will have to pay indirect taxes/VAT element to the services directly to the Consultant unless otherwise agreed.

Eligibility: There are no eligibility restrictions
 
Consultant Profile: Corporate services are required. The Consultant will be a firm or a group of firms with proven experience in the administrative management, procurement, design and supervision of similar construction works and acquiring the equipment for projects with comparable climatic and geological conditions.
 
It is anticipated that the Consultant’s team shall include the following expertise with short-term support as required in other disciplines:
  1. International Project Manager
  2. IFI Procurement and Contracts Specialist
  3. Local Project Manager; (iv) International and Local Municipal Solid Waste Engineers;
  4. Finance and Disbursement Specialist;
All experts should preferably have  5 years’ experience of the activity, which they are proposed for in a similar position including: (a) have design and project management experience gained in countries with conditions similar to the Kyrgyz Republic; (b) have construction and supply experience gained in countries with conditions similar to the Kyrgyz Republic; (c) have experience in design of municipal solid waste management projects; (d) have experience in (i) planning and design activities; (ii) assistance with planning and design activities; (iii) project management; (iv) project management assistance; (v) engineering; (vi) procurement of goods, works and services; (e) have good knowledge of procedures and rules of procurement of international financial institutions, such as the EBRD, World Bank or ADB, knowledge of FIDIC and/or World Bank/EBRD Supply and Installation contractual arrangements; (f) have good knowledge of requirements of Kyrgyz legislation concerning construction, financial, accounting and disbursement issues; (g) the Consultant shall ensure the Russian speaking staff on their team or arrange for the translation/interpreting when necessary.
 
Submission Requirements: In order to determine the capability and experience of consultants to be shortlisted, the information submitted should include the following:
 
(a) brief overview of the firm/group of firms including company profile, organisation and staffing;
 
(b) details of similar experience of firm or group of firms and related assignments undertaken in the previous five years, including information on contract value, contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided, assignment budget, percentage carried out by consultant in case of association of firms or subcontracting, main activities, objectives;
 
(c) CVs of key experts who could carry out the Assignment detailing qualifications, experience in similar assignments, particularly assignments undertaken in the previous five years, including information on contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided, assignment budget, main activities, objectives.

Design and Construction of a New Sanitary Landfill in the City of Bishkek

Municipal Enterprise “Bishkek Sanitary Landfill” for and on behalf of Bishkek City Administration, Kyrgyz Republic hereinafter referred to as “the Employer”, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) and of a Grant from the Investment Facility for Central Asia of the European Union EUIFCA (the Grant) towards the cost of Bishkek Solid Waste Project.

The Employer now invites sealed tenders from contractors for the following contract to be funded from part of the proceeds of the loan and the grant:

Design and Construction of a New Sanitary Landfill” (hereinafter the Landfill), under which the Contractor shall perform the following works:

  • Survey and design works, including design approval and obtaining of a construction permit.
  • Obtaining of an architectural planning assignment, calculations, preparation and approval of detailed design of the Landfill with its internal and external infrastructure including construction of an access road, extension of power and water supply as defined in the technical specification.
  • Construction and commissioning of the Landfill, with its internal and external infrastructure, including construction of an access road, extension of power and water supply as defined in the technical specification.
  • Preparation of as-built documentation
  • Remedy all revealed defects of the Landfill during construction or during the Warranty Period.

Tendering for the contract to be financed with the proceeds of the loan from the Bank and the Grant is open to firms from any country.

Experience of construction

  1. Construction of at least  2 (two) sanitary landfills.
  2. Construction of at least 1 (one) sanitary landfill of capacity at least 1 (one) million m3 of waste, as part of the above two contracts or separately.
  3. Construction of an artificial impermeable barrier for groundwater and surface water protection on a site of at least 9 (nine) hectares, as part of the above two contracts or separately. 
  4. Construction of at least 1 (one) facility for leachate management of capacity at least 100 m3/day, avoiding dangerousness for groundwater and surface water, as part of the above two contracts or separately.
  5. Construction of at least 1 (one) system for landfill gas collection / utilization, as part of the above two contracts or separately.
  6. Construction and putting into operation of at least 1 (one) facility for incineration of remains of animals, as part of the above two contracts or separately.
  7. Construction experience gained in similar climatic conditions (from +30oC to -30oC).

AND

Design experience   

  1. Designing of at least 2 (two) sanitary landfills of capacity at least 1,000,000 (one million) m3 of waste, including all necessary infrastructure, in particular systems for leachate collection / management and landfill gas collection / utilization. 
  2. Designing of an artificial impermeable barrier for groundwater and surface water protection on a site of at least 9 (nine) hectares, as part of the above two contracts or separately. 
  3. Designing of at least 1 (one) facility for incineration of remains of animals, as part of the above two contracts or separately.
  4. Designing experience gained in similar climatic conditions (from +30oC to -30oC).

4. Requirements to personnel

Construction Management Team   

Project Manager – 8 years of experience in construction works of sanitary landfills:

  • higher education in the field of civil engineering or in the field of economy/finances,
  • 8 years of experience gained applying of FIDIC contract conditions in management of construction works,
  • 5 years of experience gained applying of FIDIC contract conditions in management of construction works of waste management objects, including construction of one sanitary landfill according to requirements of the “Yellow Book” (FIDIC, 1999),
  • construction experience gained in similar climatic conditions (from +30oC to -30oC),
  • mandatory knowledge of English and preferably knowledge of Russian.

Site Manager – 8 years of experience in construction works of sanitary landfills:

  • higher education in the field of civil engineering,
  • 8 years of experience gained applying of FIDIC contract conditions in management or site supervision of construction works,
  • 5 years of experience gained applying of FIDIC contract conditions in site supervision of construction works of waste management objects, including construction of one sanitary landfill according requirements of the “Yellow Book” (FIDIC, 1999),
  • experience of sanitary landfills construction in similar climate conditions (from +30oC to -30oC),
  • mandatory knowledge of English and preferably knowledge of Russian.

Civil Engineer - roads – 5 years of experience in road construction works:

  • higher education in the field of civil engineering,
  • 5 years of experience gained applying of FIDIC contract conditions in road construction works,
  • experience of roads construction in similar climate conditions (from +30oC to -30oC),
  • mandatory knowledge of English and preferably knowledge of Russian.

Designing Team:

Chief Engineer – 8 years of experience in designing works,

  • higher education in the field of civil engineering or architecture,
  • designing of three sanitary landfills, including at least one of capacity more than one million m3, with all required infrastructure elements, including leachate and landfill gas collection / utilisation systems,
  • designing of at least two sanitary landfills, commissioned in operation,
  • experience of sanitary landfills designing in similar climate conditions (from +30oC to -30oC),
  • mandatory knowledge of English and preferably knowledge of Russian.

Waste management expert – 8 years of experience in of designing works of sanitary landfills:

  • higher education in the field of civil, environmental or chemical  engineering,
  • designing of sanitary landfills, including  one of capacity more than one million m3 and with all required infrastructure elements, including leachate and landfill gas collection / utilisation systems,
  • participation in designing of, at least, one sanitary landfill, commissioned in operation,
  • experience in evaluation of efficiency and safety of landfills operation (including analysis and preparation of tariffs, evaluation of landfill gas utilisation, results of monitoring, etc.) and improvement of their operation efficiency,
  • experience of sanitary landfills designing in similar climate conditions (from +30oC to -30oC),
  • mandatory knowledge of English and preferably knowledge of Russian.

Geologic engineer – 5 years of experience in designing works:

  • higher education in the field of technical engineering or natural sciences,
  • designing of sanitary landfills during the last three years, including calculation of bearing capacity of foundations,
  • experience of sanitary landfills designing in similar climate conditions (from +30oC to -30oC),
  • mandatory knowledge of English and preferably knowledge of Russian.

Hydrogeologist – 5 years of experience in designing works:

  • higher education in the field of geology,
  • designing of sanitary landfills during the last three years, including in conditions of high groundwater table and creation of groundwater monitoring network, 
  • experience of sanitary landfills designing in similar climate conditions (from +30oC to -30oC),
  • mandatory knowledge of English and preferably knowledge of Russian.

Environmental specialist – 5 years of experience in participation of designing works:

  • higher education in the field of natural sciences,
  • designing of sanitary landfills during the last three years, including elaboration of Landfill Operation Manual, 
  • experience in evaluation of efficiency and safety of landfills operation (including analysis and preparation of tariffs, evaluation of landfill gas utilisation, results of monitoring, etc.) and improvement of their operation efficiency,
  • experience of sanitary landfills designing in similar climate conditions (from +30oC to -30oC),
  • mandatory knowledge of English and preferably knowledge of Russian.

5. Equipment Availability. The Tenderer shall provide information on any special equipment that he believes, will be required in order to complete the Project works. In addition, he shall confirm that he will have ready access, through hire, lease or other to such equipment.

6. Financial position. The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 4 (four) months, estimated as not less than EURO 2,000,000 (two million) equivalent, taking into account the applicant's commitments for other contracts.

7. Litigation History. The Tenderer should have a Litigation History without major claims. A consistent history of awards against the Tenderer or any partner of a joint venture may result in failure of the application. The Tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last 5 five years. The Employer reserves the right to exclude tenderers which have a litigation history showing more than two cases during the last five years where the award was against the tenderer.

8. Other criteria. The Tenderer shall demonstrate it is able to meet the requirements of Kyrgyz legislation. These include but are not limited to construction license, design license or availability of certified designers. If such licenses and certificates are available at the time of the tender submission, their copies shall be provided. Otherwise, the Tenderer must clearly state that all required licenses will be submitted within 42 days after the contract award.
The goods, materials, works and equipment under this Tender Document shall be designed, manufactured and supplied in accordance with the appropriate Kyrgyz laws, codes and regulations or they shall conform to the respective European and international standards, and quality certificate ISO 9001 or equivalent. In case of discrepancies between state and international standards, the preference shall be given to the standards with more strict requirements.

    The audited balance sheets for the last 3 years shall be submitted and must demonstrate the soundness of the Tenderer’s financial position, showing long-term profitability. Where necessary, the Employer will make inquiries with the Tenderer's bankers.
     
  • Average Annual Turnover
    The Tenderer shall have an average annual turnover as prime contractor (defined as billing for works in progress and completed) over the last 3 years of not less than 3,000,000.00 Euros equivalent for Lot 1 and 800,000.00 Euros equivalent for Lot 2.  In case of participating in both lots the threshold is calculated cumulatively.
     
  • Financial Resources
    The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 4 (four) months, estimated as not less than 500,000.0  Euros equivalent for Lot 1 and 150,000.00  Euros equivalent for Lot 2. In case of participation in both lots the threshold is calculated cumulatively, taking into account the Tenderer's commitments for other contracts.
     
  • Experience
    The Tenderer shall demonstrate that it has successful experience as prime contractor in the execution of at least three projects of a nature and complexity comparable to the proposed contracts within the last 5 years (with activity in at least nine (9) months in each year), each with a value of at least 1,000,000.00 Euros , that have been successfully and substantially completed and that are similar to the proposed Work, if the Tenderer submits the tender for Lot 1, and 400,000.00 Euros – for Lot 2. In case of participation in both lots the threshold is calculated cumulatively. In addition, the Tenderer shall have the following specific experience: construction of a minimum of 15 km of pipeline laying works (any of water, waste water or gas pipelines) in one (1) year if the Tenderer submits the tender for Lot 1 and a minimum of 5 km – for Lot 2. In case of participation in both lots the threshold is calculated cumulatively.
     
  • History of non-performing contract
    Non-performance of a contract did not occur within the last 3 (three) years prior to the deadline for    application submission, based on all information on fully settled disputes or litigation. 
     
  • Pending Litigation
    All pending litigation shall in total not represent more than 30 percent of the Tenderer’s net worth and shall be treated as resolved against the Tenderer.

Municipal Enterprise of Naryn city “Vodokanal” hereinafter referred to as “the Employer”, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) and a grant from the Swiss Secretariat for Economic Affairs (SECO) towards the cost of Water and Wastewater Rehabilitation in the City of Naryn.

The Employer now invites sealed tenders from contractors for the following contract(s) to be funded from part of the proceeds of the loan and the grant:

  • Lot 1 - Rehabilitation and Extension of the Water Networks:

1)         Rehabilitation and Extension of Water Networks of Naryn city (8,668 m);

2)         Reconstruction of the Water Intake Facility (two boreholes and chlorination plant).

  • Financial Resources – The Tenderer shall complete Attachment 2, Financial Information, provided in Section IV, Tender Forms, and demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 4 (four) months, estimated as not less than 400,000 (four hundred thousand) Euro equivalent for Lot 1; 80,000 (eighty thousand) Euro equivalent for Lot 2; and 400,000 (found hundred thousand) Euro equivalent for Lot 3. In case of participation in more than one lot, the threshold is calculated cumulatively, taking into account the Tenderer's commitments for other contracts.
  • Experience – The Tenderer shall have experience under contracts in the role of contractor or management contractor for the last five (5) years prior to the tender submission deadline and with activity in at least nine (9) months in each year.  The Tenderer shall demonstrate that it has successful experience as prime contractor in the execution of at least three projects of a nature and complexity comparable to the proposed contracts within the last 5 years, each with a value of at least 1,000,000 Euros, that have been successfully and substantially completed and that are similar to the proposed Work, if the Tenderer submits the tender for Lot 1, 150,000 Euros – for Lot 2 and 1,000,000 Euros – for Lot 3. In case of participation in few lots the threshold is calculated cumulatively.

In addition to or as part of the above contracts, the Tenderer shall have the following specific experience: construction of a minimum of 5 km of pipeline laying works (any of water, waste water or gas pipelines) in one (1) year if the Tenderer submits the tender for Lot 1 and a minimum of 5 km – for Lot 3. In case of participation in both lots the threshold is calculated cumulatively.
