Track Rehabilitation This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD website, Procurement Notices (www.ebrd.com) on 19.12.2006, 25.02.2008, 14.05.2009, 18.11.2013 and 02.02.2015 and in ‘Pobjeda’, Montenegrin newspaper. Railways of Montenegro for Infrastructure ‘Željeznicka Infrastruktura Crne Gore AD (ZICG)”, hereinafter referred to as “the Employer”, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of a project to undertake emergency rehabilitation of the railway infrastructure. The Employer now invites sealed tenders from contractors for the following contract to be funded from part of the proceeds of the loan: The works on the Vrbnica –Bar line for track rehabilitation with the length of the section Kolašin – Kos (open line) of 9.864,70 m, the length of station tracks of 786,67 m for 1st track; 828,86 m for 2nd track (running track) and 794,21 m for 3rd track and with the railway line electrified 25 kV, 50 Hz single-phased system and with single-track and standard gauge, in one contract, will include: Section 1: ‘Kolasin-Kos’ Open track (km 340+991.60 – km 350+856.27) repair and change of the existing track components (superstructure) with electrical devices and services. Section 2: Station ‘Kos’: Main track (km 350+856.27 - km 351+685.13) Station tracks (km 350+857.25 - km 351+684.69) repair and change of the existing track components (superstructure) and switches with electrical devices and services. Completion time for all works under the contract is 15 months. Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from any country. To be qualified for the award of a contract, tenderers must satisfy the requirements regarding experience, personnel, equipment, financial position and litigation history, specified below: 1. General Experience. The Tenderer shall meet the following minimum criteria: an average annual turnover (defined as annual earnings, expressed in its EURO equivalent) as a contractor over the last five (5) years shall be not less than EUR thirteen million (13,000,000) equivalent. JVCA (Joint Venture, Consortium or Association) must satisfy collectively the above criterion, for which purpose the relevant figures for each of the partners shall be added to arrive at the joint venture's total capacity. At the same time each partner shall meet not less than thirty (30) percent of the criterion, while the lead partner shall meet not less than seventy (70) per cent of it. successful experience as prime contractor in the execution of at least three projects of a nature and complexity comparable to the proposed contract within the last Five (5) years; each with a minimum value of at least EURO Five (5) million equivalent; with specific experience in railway track laying and railway electrical works (railway track laying, of at least Eight (8) km put in place in one year; railway electrical works, of at least Five (5) km of contact network installed in one year). Personnel Capabilities. The Tenderer shall provide suitably qualified personnel as detailed in the tender documents. Equipment Capabilities. The Tenderer shall own, or have assured access to (through hire, lease, purchase agreement, availability of manufacturing equipment, or other means) of the key items of equipment as detailed in the tender documents. Financial Position. The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 3 months, estimated as not less than EURO 1,600,000 equivalent, taking into account the Tenderer's commitments for other contracts. The audited balance sheets for the last Five (5) years shall be submitted and must demonstrate the soundness of the Tenderer's financial position, showing long-term profitability. Where necessary, the Employer will make inquiries with the Tenderer's bankers. Litigation History. The Tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last five years. A consistent history of awards against the Tenderer or any partner of a joint venture may result in failure of the application. The Invitation for Expressions of Interest follows the General Procurement Notice for this project published in Procurement Opportunities, on the EBRD website on 2nd February 2015.

 

Railways of Montenegro ‘Željeznicka Infrastruktura Crne Gore AD  (ZICG)” intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (“the Bank”) towards the cost of a project to undertake emergency rehabilitation of the railway infrastructure where the services of the Construction Supervision Consultant are required. The project is subject to the EBRD Procurement Policies and Rules.

 

The Employer now invites expressions of interest from suitably qualified firms who are interested in providing assistance to the Employer to facilitate the timely and effective implementation of the Project by advising the Employer on the administration of the EBRD-funded contract with due diligence and by carrying out the duties of the Engineer assigned to him in the contract which is a re-measurement unit rate contract based on FIDIC Conditions of Contract for Construction, Red Book, 1999, as modified through Particular Conditions. The Consultant shall exercise the authority attributable to the Engineer, as specified in or necessarily implied from the contract, to ensure timely, satisfactory completion of the Works in accordance with the contract. The consulting services (“the Services”) include Supervision of one Civil Works Contract for:

 

  • Rehabilitation of Tunnel no 187 at km 353+657.39 - km 353+895.93 located on the Vrbnica-Bar railway line, between passing point Kos to Trebješica on km 353+657,39 - 353+895,93 (the total length of 238.54 meters)
  • Rehabilitation of Tunnel no 190 at km 354+831.93 - km 356+271.93 located 7-9 km from the station Trebjesica to Kolasin on km 354+831,93 - 356+271,93 (the total length of the tunnel is 1440 m)
  • Rehabilitation of Tunnel no 193 at km 357+235.96 - km 357+631.96 located 5-6 km from the station Trebjesica to Kolasin on km 357+235,96 - 357+631.96 (the total length of the tunnel is 396 m)

 

The assignment is expected to start immediately after selection of Consultant and respective consultancy contract signature (which is expected by end of May 2016) with estimated total duration of 45 (forty five) months (about 18 months for Civil Works execution, 24 months for Defects Notification Period and 3 months for post DNP period for Performance Certificate issuance and other closing activities).

 

Corporate services are required. The Consultant will be a firm, or consortium of firms, and is expected to have appropriate experience in the supervision of projects in the rail sector in similar business environments and in accordance with FIDIC conditions of contract.

 

The Consultant’s team is expected to include the following key experts:

  1. Team Leader / Resident Civil Engineer (managing, civil works on tunnel rehabilitation) should be able to demonstrate the following qualifications / skills:
  • A graduated civil engineer having at least fifteen (15) years of general experience in civil engineering and civil management in area of expertise.
  • At least 7 years of proven professional experience in the railway sector related to design, supervision or civil works on the similar projects.
  • Extensive experience as full time Team Leader/Engineer for similar projects, with at least two (2) projects in the role of the Engineer under FIDIC which were successfully completed.
  • Fluency in written and spoken English

 

  1. Resident Electrical Engineer (electrical works on tunnel rehabilitation - works for contact network) should be able to demonstrate the following qualifications / skills:
  • A graduated Electrical engineer having at least ten (10) years of general experience in tunnel engineering preferably in the transport sector.
  • At least 7 years of proven professional experience in the railway sector related to relevant design, supervision or civil engineering works on the similar projects.
  • Extensive experience in similar projects, with at least two (2) projects in the similar roles under FIDIC which were successfully completed.
  • Fluency in written and spoken English

 

  1. Any additional assistance including non-key (e.g. Electrical Engineer for telecommunication) technical staff and back office support, if required to complement the knowledge of key experts in order to fulfil the Consultants tasks under ToR), will have to be provided and any associated cost will be assumed to be covered by key experts’ remuneration rates apart from non-key technical staff as agreed during negotiations.

 

One of Key Expert has to be certified for work on electrified line for line closure organisation.

The Consultants should have certificates/licenses/permits or similar confirmation of the qualifications as required by Montenegrin legislation. A foreign company requesting to issue an equivalent of a license for foreign national needs to submit: company registration in Montenegro document, certified translations of the original licenses and those of the company registration documents in their home country. A foreign individual requesting to issue equivalent of a license needs to submit: certified translations of their passport, diploma and the original license. Such documents, if cannot be provided with the expression of interest will have to be provided at a contract signature stage.

 

Eligibility: Procurement will be open for all the Consultants except those restricted in the EBRD’s list of ineligible entities. The proceeds of the loan shall not be used for the purpose of any payment to persons or entities or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations and the Client’s Country prohibitions.

 

Procurement of the consultancy services will be conducted in accordance with the EBRD’s Procurement Policies and Rules. The consultants will be selected following the shortlisting procedures. The selection will normally be made from responses to this notification only. Consultants will NOT be asked to submit a proposal. The highest-ranked Consultant will be selected from a shortlist and be invited to negotiate the contract, subject to availability of funding. The consultancy contract will be based on the EBRD’s HARMONIZED STANDARD FORM OF CONTRACT, Time-Based.

 

If the Consultant has been found by a judicial process or other official enquiry to have engaged in corrupt or fraudulent practices, details of the basis for the outcome of such process or enquiry shall be provided with the expression of interest.

 

The Employer reserves the right not to shortlist consulting firms that have been found to have engaged in corrupt or fraudulent practices regardless of the results of technical evaluation of the expressions of interest.

 

In order to determine the qualifications and competence of consulting firms seeking to be shortlisted, the information submitted should include the following:

  1. brief overview of the firm/group of firms including company profile, organization and staffing;
  2. details of similar experience of firm or group of firms and related assignments undertaken in the previous five years, including information on contract value, contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided, assignment budget, percentage carried out by the Consultant in case of association of firms or subcontracting, main activities, objectives;
  3. CVs of key experts who are suggested to carry out the assignment detailing qualifications, experience in similar assignments executed based on FIDIC Red Book contract conditions, particularly assignments undertaken in the previous five years, including information on contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided, assignment budget, main activities, objectives.

To facilitate the assessment of information the tenderers shall submit a summary of assets and liabilities, expressed in an equivalent of EUR converted based on the exchange rate reported as of the 1st of July of each year, as set by the central bank of Montenegro (CBCG). Based upon known commitments, the tenderers shall also provide a summary of the projected assets and liabilities for the next 2 years, 2015-2016, expressed in its equivalent of EUR converted based on the exchange rate as of the date of publication of the Invitation for Tenders, as set by the Central Bank of Montenegro (CBCG), unless the withholding of such information is justified by the tenderer to the satisfaction of the Client. Financial Situation 2.1. Historical financial performance The audited balance sheets for the last five (5) years shall be submitted and must demonstrate the soundness of the Tenderer's financial position, showing long-term profitability. Where necessary, the Employer will make inquiries with the Tenderer's bankers. Consistent losses or a risk of insolvency shown in the accounts may cause for the disqualification of the tenderer. Average annual turnover Average annual turnover as prime contractor (defined as billing for works in progress and completed) over the last five (5) years of Euro One and half (1,5) million equivalent. 2.3. Financial resources The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 9 months, estimated as not less than Euro 450 000 equivalent, taking into account the Tenderer's commitments for other contracts. Current Obligations and Pending Awards: The tenderer shall have the above mentioned resources free of ongoing obligations and/or pending contract awards. The tenderer shall provide information on the on-going contractual obligations and pending contract awards. The Client may reject the tender if the level of the confirmed commitments to be carried out in parallel with the Contract exceeds the tenderer’s annual turnover for the previous year by a factor of 1.2. Experience The Tenderer shall meet the following minimum criteria: General experience: successful experience as prime contractor in the execution of at least three projects of a nature and complexity comparable to the proposed contract that have been successfully and substantially completed within the last five (5) years. The similarity shall be based on the physical size, complexity, methods/technology or other characteristics as described in Volume III, The Employer’s Requirements. (b) Specific experience: (i) Proven experience in supply, installation and commissioning of 2 (Two) projects of switch heaters and sub-stations from catenary, voltage 25/0.22 kV 50 Hz for railway transport. with a contractual price not less than 450 000 euros. (ii) The Tenderer is also required to demonstrate that it has previously performed those similar activities at paces comparable to the pace required to implement the project. Personnel Capabilities. The Tenderer shall provide suitably qualified personnel to fill the following positions. If the Contractor does not have the license for the execution of some kinds of works it is possible to hire a Subcontractor that has the appropriate licence. Equipment Capabilities. (b) The other partners shall meet not less than 40 percent of all the qualifying criteria for general experience and financial position specified above. The joint venture must satisfy collectively the criteria for personnel and equipment capabilities and financial position stated above, for which purpose the relevant figures for each of the partners shall be added to arrive at the joint venture's total capacity. Individual members must each satisfy the requirements for audited balance sheets and litigation.
