To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

  1. the tenderer has the financial, technical and production capability and capacity necessary to perform the Contract and must have at least Euro 1 000 000 annual turnover in average for last 5 years, as well as must have the profitable result of economic activity in each of last 5 years and shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the production cash flow for the contract estimated as not less than Euro 250 000 of the planned contract price;
  2.  The Tenderer shall demonstrate that it has successful experience as prime contractor in the execution of at least five projects of a nature and complexity comparable to the proposed contract within the last 5 years that have been successfully and substantially completed. The Tenderer or its specialised sub-contractor shall have a license for conducting of electrical cabling works up to 10 KV (as required by the Kyrgyz legislation);
  3.  the tenderer will be able to carry out the supplier’s maintenance, repair obligations prescribed in these tender documents.
  4.  the tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts complement or under execution by him over the last 5 (five) years. A consistent history of awards against the tenderer or any partner of a joint venture or consortia may result in rejection of the tenderer’s tender.
  5. The Tenderer shall provide suitably qualified personnel to fill the following positions. For each position the Tenderer will supply information (in table 2.5) on a first choice candidate and an alternate, each of whom should meet the experience requirements specified below:

  3.  Joint venture or consortium shall meet in whole criteria for delivery experience and production capacity, licensing, as well as the financial status referred to above, the corresponding data, that defines the overall capacity of the joint venture or consortium, shall be specified for each consortium member. Each consortium member shall meet the requirements for eligibility and trials.

This tender being financed with the proceeds of SECO’s grant, administered by the Bank, shall be carried out in accordance with the Bank’s Procurement Policies and Rules with the provision that participation is restricted to companies and firms that are registered in the commercial register in Switzerland (The lead company of the Tenderer must be registered in Switzerland). The supplied goods for the water metering shall exhibit an overall Swiss Added Value (SAV) of at least thirty percent (30%). The Tenderer may be required to substantiate the Swiss Added Value declared in the corresponding Price Schedules. The proceeds of SECO’s grant will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations. The Time for Completion for all Facilities is eighteen (18) months. To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria set forth in the Volume I.ii Paragraph 3.2 of the Tender Documents: In the case of a Tenderer offering to supply goods under the Contract which the Tenderer does not manufacture or otherwise produce, the Tenderer has been duly authorised by the goods’ manufacturers or producers to supply the goods in the Employer’s country. The Tenderer must thus provide a Manufacturer‘s Authorization Form (according Tender Volume I.iii, “Tender Forms”) for the key-equipment from the manufacturers of these equipment. Furthermore the Tenderer must prove that he has been duly authorized by the manufacturer or producer of the key-equipment to supply the goods into the Employer’s country (the key-equipment is defined in the Technical Specification Forms in Volume I.iii “Tender Forms”); The Tenderer shall demonstrate that he has successful experience as prime contractor in the execution of at least 2 (two) projects of a nature and complexity comparable to the proposed contract within the last 7 (seven) years. Comparable nature and complexity means that the project references must include the supply and installation of water meters including a remote reading system and data integration into a billing and accounting system, as well as complex civil reconstruction works. Therefore, the Tenderer must provide the fully completed and duly signed Experience Form (according Tender Volume I.iii, “Tender Forms”); The Tenderer or its agent will be able to carry out the supplier’s maintenance, repair and spare parts stocking obligations in the Employer’s country prescribed in these tender documents, i.e. to support the Employer and liaise with the suppliers of the equipment regarding maintenance, repair and common spare parts-stocking for the supplied goods and equipment; The Tenderer must thus provide the fully completed and duly signed After Sales Services Form (according Tender Volume I.iii, “Tender Forms”); Financial Position .The Tenderer has to demonstrate that he has sufficient financial means to implement the contract, i.e. that he has an average annual turnover of not less than EUR 2.5 million equivalent (before tax) over the last three years. The turnover of the Tenderer, i.e. of the lead company, includes the consolidated turnover of its company or its group of companies, if the group of companies corresponds to one legal entity. The balance sheets and income statements (preferably audited or confirmed by the State Tax Authority) for the last three years shall be submitted and must demonstrate the soundness of the Tenderer's financial position. Where necessary, the Employer will make inquiries with the applicant's bankers; The Tenderer shall provide documentary evidence for the firm's qualifications supported by QA/QC certification (e.g. latest ISO 9001 quality certificates); Litigation History. The applicant shall sign the Litigation History Form in Volume I.iii confirming that he is not involved in any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last five years; The supplied goods for the water metering shall exhibit an overall Swiss Added Value (SAV) of at least thirty percent (30%). According to SECO’s “Guidelines for the awarding of contracts”, Swiss Added Value means the difference between the offered price and the price of raw materials, components and/or other Goods and Services procured by the Contractor from outside Switzerland. This value is calculated on the basis of the Swiss SERV legislation (DEA Ordinance on Minimum content of Swiss Added Value for Export Risk Insurance [SR 946.101]: ad valorem criterion) and not on the basis of customs legislation provisions on origin. The Tenderer may be required to substantiate the Swiss Added Value declared in the Price Schedule. Non-observance of SAV indicated in the Price Schedule may constitute a fraudulent practice. The Tenderer shall work in parallel on multiple construction/ installation sites.   1.  the tenderer or its agent will be able to carry out the supplier’s maintenance, repair and spare parts stocking obligations prescribed in these tender documents.

 

  1.  the proposed models must be contemporary and be produced in series.  Good’s manufacturer must have a certificate of quality management system (ISO 9000, or its equivalent).

 

  1.  the tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts complement or under execution by him over the last 5 (five) years. A consistent history of awards against the tenderer or any partner of a joint venture or consortia may result in rejection of the tenderer’s tender.

 

Joint ventures or consortia shall satisfy the following minimum qualification criteria:

 

  1.  The firm - leader of the consortium shall correspond to at least 50% of all the above referred qualification criteria on general experience and financial status.
  2.  The rest members of the consortium shall correspond to at least 25% of all the above referred qualification criteria on general experience and financial status.
  3.  Joint venture or consortium shall meet in whole criteria for delivery experience and production capacity, as well as the financial status referred to above, the corresponding data, that defines the overall capacity of the joint venture or consortium, shall be specified for each consortium member. Each consortium member shall meet the requirements for eligibility and trials.

 

Contracts to be financed with the proceeds of the loan and the grant from the Bank will be subject to the Bank's Procurement Policies and Rules and will be open to firms from any country and origin. The proceeds of the Bank's loan and grant will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Purchaser's country.

This Invitation for Tenders follows the General Procurement Notice for this project which was published in EBRD Procurement Opportunities, 30 November 2011 (latest updated 13 February 2015).

Jalalabad City and Upravlenie "Jalal-Abadvodokanal" (hereinafter referred to as "the Employer") intend using part of the proceeds of a loan from the European Bank for Reconstruction and Development ("the Bank") and a grant from the Swiss State Secretariat for Economic Affairs ("SECO") towards the cost of the Jalalabad Water and Wastewater Rehabilitation Project. The proceeds of the Bank's loan and SECO grant will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.

The Employer now invites sealed tenders from Contractors for the following contract to be funded from part of the proceeds of the loan and the grant:

JWRP-8.4; Rehabilitation of Water Distribution Network and Installation of Domestic Water Meters in Jalalabad, including the provision of all related installation and civil works:

• Drinking Water Pipelines, Valve Chambers, Valves, Fittings, Fire Hydrants etc. for the Distribution Network:
o HDPE100, SDR17, PN10, DN225, approx. 1.1 km
o HDPE100, SDR17, PN10, DN160, approx. 1.4 km
o HDPE100, SDR17, PN10, DN110, approx. 9.4 km
o 123 Valve Chambers

• Pipes, Fittings etc. for the connection of Water Meter Boxes to the Distribution Network and for house connections, including the provision of all related installation and civil works:
o HDPE100, SDR17, PN10, DN50, total length approx. 18.6 km
o HDPE100, SDR17, PN10, DN25, total length approx. 151.1 km

• Water Meter Boxes for outdoor installation, including the provision of all related manufacturing, installation, assembly and civil works:
o Manufacturing of 216 Water Meter Boxes suited for the installation of up to 12 or up to 16 domestic water meters (DN15)
o Assembly and installation of all equipment to be installed inside the Water Meter Boxes (3'096 Water Meters DN15, Pipes, Valves, Fittings, etc.)

NOT included is:
• The supply of equipment to be installed inside the Water Meter Boxes (3'096 Water Meters DN 15, Pipes, Valves, Fittings, etc.). This supply is part of a separate Tender. It is expected that this equipment will be ready for installation from November 2015 on.

Tendering for contracts to be financed with the proceeds of the Bank’s loan and SECO grant and is open to firms, joint ventures and consortiums from any country.

To be qualified for the award of the contract, Tenderers must satisfy the following minimum criteria set forth in Vol. I.ii of the Tender Documents:

1. General Experience. The applicant shall meet the following minimum criteria:
a) average annual turnover as lead contractor (defined as billing for works in progress and completed) over the last three (3) years of EUR 500000 per year equivalent;
b) the Tenderer has satisfactorily executed at least two (2) projects of a nature and complexity comparable to the proposed contract within the last seven (7) years. The Tenderer must thus provide the fully completed and duly signed Project Reference Form (Vol. I.vi).

2. Personnel Capabilities. The applicant shall demonstrate by signing the attached List of Personnel (according to Form presented in Tender Documents Vol. I.vi) suitably qualified and professional key personnel to fill the following positions. Each candidate shall meet the experience requirements specified below:

It is expected that the applicant has to form several installation teams working concurrently to complete the works within 18 months. Thus the applicant must plausibly show with how many teams and what staffing of each team he intends to achieve the timely implementation. The applicant must fill in and sign the according forms in Vol. I.vi of the Tender Documents (list of key personnel and list of installation teams).

3. Equipment Capabilities. The applicant shall own, or have assured access to (through hire, lease, purchase agreement, availability of manufacturing equipment, or other means), at least the following key  equipment in full working order and safe, and must demonstrate by signing the attached Equipment Forms (Vol. I.vi) that, based on known commitments, the equipment will be available for use in the proposed contract.

˗ Welding and cutting equipment for the manufacturing of the water meter boxes (steel) and welding equipment for the installation works of steel pipes, including power generator – 2

4. Financial Position. The applicant shall demonstrate that he has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the supply, installation and construction cash flow for the contract for a period of three (3) months, estimated as not less than EUR 120,000 equivalent, taking into account the applicant's commitments for other contracts. The balance sheets and income statements (audited or confirmed by State Tax Authority) for the last three (3) years shall be submitted and must demonstrate the soundness of the applicant's financial position, showing long-term profitability. Where necessary, the Employer will make inquiries with the applicant's bankers.

5. Litigation History. The applicant shall sign the Litigation History Form in Vol. I.vi of the Tender Documents confirming that he is not involved in any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last five years.

6. Qualification criteria for joint ventures. Joint ventures (including) consortiums must satisfy the following minimum qualification requirements:
a) The lead partner shall meet not less than 70 percent of the qualifying criteria for financial position specified above and must have satisfactorily executed at least one (1) project of a nature and complexity comparable to the proposed contract within the last seven (7) years.
b) The other partners shall meet not less than 30 percent of all the qualifying criteria for financial position specified above.
c) The joint venture must satisfy collectively the criteria for personnel and equipment capabilities stated above, for which purpose the relevant figures for each of the partners shall be added to arrive at the joint venture's total capacity. However, individual partners of the joint venture must each satisfy the requirements for the financial position and for litigation.
In case of a contract award, the joint venture / consortium agreement shall be signed con-firming joint and several liability of all members for Contract performance.

• furnishing a payment in the amount of EUR 100 (one hundred) to the bank account of Jalal-Abadvodokanal (JVK) or the equivalent sum in KGS (Kyrgyz Som) at the rate issued by the National Bank of Kyrgyzstan at the date of payment; and
• providing evidence that the full amount of EUR 100 for the tender documents have been transferred to JVK’s account (ALL bank/ transfer fees must be covered by the Tenderer).

The tender documents will be distributed as electronic documents in pdf-format through a download-link from a File Transfer Protocol (FTP) Server. No hard copies will be sent.

All Tenders must be accompanied by a Tender security of at least 2.5% (two and a half) from the tender amount in the currency of the offer. The Tender security shall remain valid for a period of at least 148 days pursuant to Vol. I.i, paragraph 14.3.
