SEND Disagreement Resolution and Mediation Services

Within Gateshead, there are currently 440 pupils with an Education, Health and Care Plan, 546 pupils with statements of special educational need and approximately 90 young people with Learning Difficulties Assessment. The Council aims to transfer all of these statements to EHC Plans by Sept 2018. Learning Difficulties Assessments must be converted to EHC Plans by September 2016 if the young person will continue to be in education or on an apprenticeship after this date.

 Under the Education Act 1996, parent/carers had the right to appeal to the Tribunal without considering mediation. The introduction of the Children and Families Act 2014 extended this right to young people and made it a requirement for parent/carers and young people to consider mediation in the first instance.
