Additionally, the project aims to strengthen capacitiesof the Ministryof Education, Science and Technology (MoEST), National Council for HigherEducation (NCHE), Technical, Entrepreneurship and Vocational Education andTraining Authority (TEVETA) and participating institutions for policydevelopment, programme planning and implementation. In line with the National EducationSector Policy,the participating institutions in this project will expand equitable access to educationin their programmes under the SDP: A recent study on higher educationinMalawi identified limited and dilapidated infrastructure as a constraint toexpansion of equitable access and improvement of market relevance in theseinstitutions. Consequently, these institutions have submitted improvement plansas part of the proposed SDP detailing their infrastructure needs, which take upa large share of the resources allocated under the project. Given thelargeinvestment in the proposed infrastructure, there is need to ensure that theinfrastructure in the improvement plans is optimum and relevant for thedelivery of the proposed programmes. Initial appraisal of the project under World Bank Safeguards Policieshas indicated potential negative environmental and social impacts andacategory B rating; requiringthe development of Environment and Social Management Plans (ESMP) andResettlement Action Plans (RAP), also required by the Government of Malawi's EnvironmentalManagement Act (1996) and Environmental Social Impact Assessment Guidelines(1997). While most of the SDP ParticipatingInstitutionshave finalised the definition of scope of infrastructure constructionandrehabilitation works, some sites have yet to be identified and alternate sitesmight be under consideration for some of the proposed activities. In accordance with the World Bank'sOperational Policy OP 4.01 (Environment Assessment) and Malawi's EnvironmentManagement Act (60:02), detailed Environmental and Social Impact Assessment(EIA) reports have to be prepared for the infrastructure development andrehabilitation works in all of the proposed sites. The report will detail mainpotential impacts and mitigation measures to be undertaken prior to and duringconstruction phase of the project. In order to achieve this, SDPthrough NCHEseeks the services of an individual consultant to work closely with the participatinginstitutions to carry out Environmental and Social Impact Assessmentsin theseinstitutions. 2.0             SCOPE OF WORK An Environmental and Social Management Framework has beenprepared toguide on environmental screening and management of all sub-projects under SDP.Therein, it is indicated that the project has triggered the followingWorld Bank's Operational Policies: OP 4.01Environmental Assessment   OP 4.12Involuntary Resettlement OP 4.11Physical Cultural Properties Recent screening of the potentialsites has indicated that some of the construction work is likely to take placeon forested land; the consultant will therefore need to conduct furtherscreening to confirm and document the need for triggering OP 4.36 on Forests. In the process of carrying outenvironmentalassessment studies, the consultant should also make due considerationofrelevant Malawi Environmental policies, laws, guidelines, procedures andstandards for implementation of public sector projects in this category. The scope of work to prepare thestudy would involve: (i) baseline studies, through desk review of relevantdocuments available in the country and field studies; (ii) assessmentanddetermination of impacts (to include impact identification, prediction, evaluationand interpretation); and (iii) development of Environmental and SocialManagement for each sub-project for direct project impacts, includingmitigation measures, capacity and awareness building requirements to implementthose measures, and monitoring. 3.0      Objectives Theoverall objective of the consultancy is to develop anEnvironmental and Social Impact Management and Resettlement Plans foreachsub-project of SDP. The expected outputs of theassignment are: i.           Environmental and Social Impact Assessment Report thatincludes an Environmental and Social Management Plan and an Environmental andSocial Monitoring Plan ii.           ResettlementAction Plan. 4.0       Tasks to be carried out The consultant will carry out the following: i.              Collect,analyse and present baseline information on the environmental characteristicsof the existing situation in the proposed project sites. Given that amajorityof sites will be within the confines of pre-selected institutions, thedescription and analysis should include: ·        Physical environment, which includes watercourses, forested areas,trees, etc. ·        Social environment, includingpopulation census and socio-economicactivitieson proposed sites that are likely to be affected during the project, and where appropriateidentify areas of cultural significance, community structures, genderandmembers of vulnerable groups' dynamics, and etc. ii.              Identifyand describe all pertinent legislation, regulations and standards governing theenvironmental quality, solid and liquid waste management, health and safety. iii.              Identifypotential environmental impacts that could result from the project. Describeand analyse all significant changes expected due to the proposed projectsfocusing on both negative and positive impacts. The impacts include environmental,and social impacts which could both be positive or negative. iv.              Analyse anddescribe occupational and health concerns likely toarise as a result of construction and operations of the proposed activities. v.                    Undertake a full public participationand consultations on the positive and negative impacts of the projectamongstthe key stakeholders at District Council level; communities includingparent-teachersassociations, students associations, teachers unions, and other relevant stakeholders. Organise meetings and forumsfor public participation to enable interested and affected parties topresenttheir concerns and opinions regarding the proposed project. a.  Propose feasiblemitigation measures for the identified negative environmentaland social impacts that could result from the proposed project activities. b.  DevelopEnvironmental andSocial Management Plans (ESMP) that willinclude those mitigation measures along with monitoring and institutionalmeasures to eliminate, minimize or reduce to acceptable levels the adverse socialand environmental impacts that could minimize the socio-economic benefits ofthe proposed activities. Provide a cost outlay for the proposed measures aswell as their institutional and financial support mechanisms. c.   Develop anEnvironmental and Social Monitoring Plan (ESMP) whichshall provide specific descriptions and technical details of monitoringmeasures, including parameters to be measured, methods to be applied,andsampling locations, frequency of measurements or data collection, anddefinitions of thresh-holds that will signal the need for corrective actions. TheMonitoring Plan will also describe the monitoring and reporting procedures aswell as the timeframes and implementation mechanisms and provide details of thestaffing requirement and cost outlays for the implementation of the plan. d.  Prepareappropriate Resettlement Action Plans (RAP) in line withthe World Bank policy framework guidelines on Involuntary Resettlement (OP4.12), the Environmental Management Act (1996) and other the legal requirementsof the country. 5.0Report reviews NCHE will establish a ReviewCommittee comprising officials (2 from NCHE, 1 from MoEST and 1 from each participatinginstitution) to guide the consultant. The consultant will produce a series ofreports in English during his/her assignment. The reports will be submitted intriplicate to the Review Committee through the SDP Project Coordinator at NCHEaccording to the following deliverables. 6.0 Deliverablesof the Consultancy Deliverables will besubmitted to NCHE for reviewandapproval through the Skill Development Project Coordinator. The followingdeliverables will be expected from the assignment: # Deliverable TimePeriod Three (3) hard copies of an inceptionreport that clearly illustrates how the assignment shall be executed,including proposed time-lines and milestones. 1 week after contractsigning Three (3) hard copiesofEnvironmental and Social Impact Assessment Report that includes anEnvironmental and Social Management Plan and an Environmental and Social MonitoringPlan as one document for each Participating Institution. 2 weeks afterpresentation of Inception Report. Three (3) hard copies of Resettlement Action Plans for eachParticipating Institution; 1 week aftersubmission of the above reports. The services are required over a period of Twelve months and will beconducted as much as possible in parallel with the technical studies on Chimgonda and Mpatamanga hydropower projects. The project aims at increasing access to finance for the currently unbanked but bankablepopulation of Malawi.  The project's primaryend-beneficiaries will be the financially excluded population. The RBM intends to usepart of the proceeds of the credit to make eligible payments for the services of an individual as a technical assistance expert toassess the feasibility of establishing a centralised database system to be used by the Registrar of Financial Institutions (theRegistrar) in the registration of employees andemployers participating in the national pension scheme as part of enforcing andmonitoring compliance with the Pension Act 2010. The GoM introduced amandatory national pension scheme in which all employers, except those duly exempted, are requiredto place employees on pension.Currently, it is estimated that about 200,000 employees from the private sector are members of the national pension scheme withscope to increase as enforcement of the mandatory law expands. The scheme is primarily designed as a defined contribution schemebut defined benefit funds are also permitted. The law provides members with benefit portability rights, giving members the righttochoose a pension scheme depending on preference. Employees changing jobs are also expected to move with their pension benefits.However, considering that there is currently no centralized collection or administration system, registration criteria in a pensionfund is dependent on the system used by the administrator of the pension fund and as suchthere is no unique identification formembers that are switching between pension funds. The Registrar therefore wishes to explore how to enforce and monitor complianceby employers through the system as well as assist in tracking member movements, trends in benefits payments, unclaimed retirementsavings and minimising the existence of multiple accounts - including the possibility of generating unique personal identificationnumbers to both employers and employees. 4.     Objectives The major objective ofthe assignment is to carryout a feasibility study for the establishment of a centralized national pension database (CNPD) system.The feasibility study will assist the Reserve Bank of Malawi, as a Registrar to determine a detailed schedule of requirement forpossible establishment of a centralized national pension database (CNPD) system, based on the existing infrastructure and anyfuture requirement in Malawi. 5.     Scope of the Assignment The Scopeof the assignment shall include analysis of existing approaches, systems, and database being used by employers, services providers,and government agencies. In addition, the scope shall also include; research work into functional and non-functional requirementsfor the CNPD system. It also expected that if the outcome of the study indicates that it is not feasible to establish CNPD, thereport shall provide preferred alternatives to establishment of a CNPD based on the current practices andinfrastructure. 6.     Tasks Research into the possibility of establishing a CNPDResearch into functional and non-functional requirements for the CNPD: i.          Review and assess the current information and communicationtechnology infrastructure used by the Registrar with a view to ascertain the minimum hardware and software requirements fortheproposed CNPD as well as approaches to resolving any integration issues with all stakeholders; ii.          Determine the security needs for the creation,processing,storage and sharing/transmission of data into and out of the proposedCNPD; and iii.          Undertake and deliver a supply market analysis to enhance knowledge by RBM officials inthe types of available systems, the key suppliers and their respective business profiles; 7.     Deliverables The consultant shall deliver the following: 1.     An interim report, subject to the approval of the RBM, within 30 days of commencement of the consultancy setting out thefollowing: i.          Whether a CNPD is feasible given the current arrangement ofthe pension system; ii.          If so, what changes to the existing administration structuresand practice of the pension funds would be required. iii.          Recommendations for next steps in the design andpre-procurement study of the system. 2.     A final report, which will incorporate RBM comments on the interim report and the adoptedrecommendations. This will beno later than 20 days after receipt of comments on the interim report from RBM. The final report will also set out a detailedapproach to be considered if it is feasible to establish a CNPD. Since independence in 1964,the Malawi Government has used variousstudent financing or supporting mechanisms: full scholarships (1964 -1985),University managed loan scheme (1985 - 2000), MoEST managed loan scheme (2000 -2008), Public Universities Students Loan Trust (2008-2010), Bank managed loanscheme (2010 - 2011) and MoEST managed loan scheme (2012- present). The aim ofthe loan schemes was to hedge students from disadvantaged background againstthe adverse effects of the policy direction in 1985 that required that studentsfinancially contribute towards their university education. The loans schemes, however,suffered from two inherent weaknesses.Firstly, the loan schemes did not have autonomous and transparent mechanisms toidentify deserving candidates for the loans. Secondly, the schemes did not haveeffective loan recovery mechanisms. Therefore, in order to sustainably increase equitable access ofhigher education and address national skills gap, the MoEST requires aneffective and efficient student financing mechanism that is autonomous,transparent, with robust mechanisms for candidates' identification and loanrecovery. 2.Objectives of theConsultancy Theobjective of this consultancy is to helpthe GOM todevelop a viable student financing mechanism and management system (includingmeans testing and recovery mechanism, operational guidelines, and managementsystem) for higher education sub sector in Malawi by reviewing current and paststudent financing mechanism in Malawi and best practices in other countries(particularly in Sub Saharan Africa) and by proposing a viable studentfinancing mechanism and management system suitable to Malawi. Scope of Work In order toreview theexisting and design students financing mechanism and potential financingmechanism thereof, the work will include but not limited to: Student FinancingMechanism: (a)           Review current national policies, law, relevantdocuments governing the student financing mechanism; (b)         Review current and possible student financingsources and sustainability measures; (c)          Analyse government subvention funding to various highereducation institutions and relevant data for student financing mechanism; (d)         Analyse various models of student  financing mechanism and theirsuccess storiesin other countries; (e)         Consult stakeholders; on a variety of financingoptions using financial models to show short & long term implications ofeach model. Student Financing ManagementSystem: (f)           Recommend astudent financing management system withits required ICT infrastructure (Hardware, Software and connectivity); including  butnot limited to i.           Systems to implement Means Testing including thedesign of paper and online loan application form ii.           Systems to ensure individual account management andmaintenance iii.           Systems to record and monitor loan repayment iv.           Systems to link loan events (e.g. applications,monthly repayment reminders, notices of arrears) to communication products (g)         Facilitate a workshop to present the results of thereview and the final design of the student financing management system. 4. Theobjectiveof the SDP is to increase access, market relevance and result orientation ofsupported skills development institutions in agreed priority areas. TheTechnical, Entrepreneurial and Vocational Education and Training (TEVET)Authority is one of five participating institutions, and TEVET Improvement Plan(TIP) is part of SDP, and aims at increasing access to employment-orientedskills development programmes in rural areas; broadening the range ofmarket-relevant programmes at technician level in priority areas in partnershipwith employers and industry; improving the capacity for quality assurance inthe TEVET system and conducting impact evaluation to test the effectiveness ofalternative interventions. The TIP partners are Ministry of Education, Scienceand Technology, Ministry of Labour, TEVET Authority and TEVET Institutions. As part of preparations for the TIP there is need to review the TEVETApprenticeship System. The current apprenticeship system is centrallymanagedby TEVET Authority who are responsible for recruitment and placement ofpre-apprentices to private and public institutions, and coordinating bothinstitution and industry-based training. Annually an average of 1,200schoolleavers with Malawi School Certificate of Education are selected for placementinto regulated apprenticeship program which account for an average 20% of thecollege capacity, 80% being filled by trainees on parallel programs which are unregulated.This makes the whole apprenticeship system difficult to manage as a result. The apprenticeship system has over the years faced a number challengesat both demand and supply sides including management of different parallelnational TEVET curricula, management and implementation of assessmentandcertification processes, delivery of TEVET curriculum, infrastructuredevelopment and industry participation. These challenges have resulted ininefficiencies and ineffectiveness of the apprenticeship system that requireimprovement. Purpose of theConsultancy The overallpurpose of this consultancy is to review the currentsituation in TEVET Apprenticeship in Malawi and best practices in othercountries, and propose an efficient, equitable and responsive TEVETApprenticeship System in Malawi capable of producing sufficient and competitivelabour force. Specifically the consultancy is aimed atproviding recommendations/proposals to the following specific questions: i.     how to ensure increased participation of privatesector to open up for apprenticeships, ii.     how to improve assessment  and certification ofapprenticeshipprogrammes., iii.     how to ensure that skills learned throughapprenticeship elsewhere are better aligned with Malawi TEVET qualification framework, iv.     how to measure impact of apprenticeship (i.e.Skills learned, employment outcomes, v.     how to ensure equity (access of the poor) toapprenticeship, vi.     how to improve stakeholder commitment andparticipation. Scope of Work To meet the purpose ofthe assignment, the individual consultant shall undertake a SituationalAnalysis on the following key tasks and make recommendations: i.           Review the assessmentand certification systems of apprentice able occupations in Malawi; ii.           Conduct institutional capacity assessment ofTEVET providers, quality assurance bodies, assessment and awarding bodies inrelation to the Apprenticeship System in Malawi; iii.           Assess theparticipation of industry in apprenticeship system in Malawi; iv.           Conduct a comparativestudy with other countries within Africa and beyond on best practicesin theapprenticeship system from recruitment through training to certification. 4.     Expectedoutputs/deliverables The main outputof the assignment is a proposed efficient and responsive TEVET ApprenticeshipSystem. While significant progress in the regulatory framework has been made, the formalfinancial sector in Malawi remains small, concentrated and services a narrow clientele. The Reserve Bank of Malawi (RBM), on behalfof the GoM has taken a leading role in the development of a policy and institutional framework for the development of the financialsector. A key intervention in these reforms is the implementation of the five-year Financial SectorTechnical Assistance Project (FSTAP) which the GoM is financing with a credit from the International Development Association (IDA)of the World Bank. The project aims at increasing access to finance for the currently unbanked but bankable populationofMalawi.  The project'sprimary end-beneficiaries will be the financially excludedpopulation. The Reserve Bank of Malawi intends to use part of the proceeds of the credit to make eligiblepayments for the services of a resident advisor on supervision of pension to build technical capacity of the Pension and InsuranceSupervision Department to regulate and supervise the pension industry in Malawi. Theconsultancy is open to individual consultants and the prospective candidate will be under the supervision of the Pension andInsurance Supervision Department (PISU). 2.0Objectives of the Assignment The main objectiveof the assignment is to build capacity of the pension and insurance supervision department to effectively and efficiently carry outregulation and supervision of pension funds in line with international standards and best practice. Specific objectives of theassignment are as follows: 1.     To assess effectiveness of existing pension supervision activities againstinternationalstandards and best practice and implement improvements to ensure compliance; 2.     To recommend a supervisory philosophy and approach for the regulation of pension entities;and 3.     To develop procedure manuals that will support processes in pension supervision, includingbut not limited to licensing, off-site surveillance, on-site examinations, and enforcement; 4.     To strengthen capacity for staff in the Pension and Insurance Supervision Department of theReserve Bank of Malawi to effectively supervise the pension industry. 3.0Scope of the assignment Theassignment is divided into three phases as follows: 3.1Phase one (1 month) In thefirst phase, the Consultant will conduct a comprehensive review of the existing market structure and effectiveness and adequacy ofexisting supervision activities. The work shall focus on, but not limited to: Review the Pension Act to appreciate the Malawian pensionmodel;Assess the risks to which pension funds in Malawi are exposed andadequacy of the mitigating activities;Review existing regulations for pension funds and pension serviceproviders;Assess adequacy of prudential requirements and standards of marketconduct;Review of existing pension supervision approach;Assess PISU's supervision objectives, organisation structure and jobdescriptions;Assess reporting requirements of various pension entities; andReview previous consultancy reports on regulation and supervision ofpension funds. 3.2 Phase two (2 months) During thisphase, the Consultant based on work completed in the first phase must: Recommend a supervision philosophyand approach for on-goingsupervision of all pension entities including pension funds, administrators, investment managers andcustodians;Develop supervision processes procedure manuals covering all pensionentities in the areas of licensing,off-site supervision, on-site supervision and enforcement actions to support the supervisionapproach;Develop, after liaising with the Pension and Insurance Department,relevant directives and guidelines that will facilitate adequate regulation and supervision of pension entities as provided for inthe Pension Act. Draft necessary documentation for the design and implementation ofan effective pay-out phase appropriate for the national pension scheme in Malawi;Undertake a training needs assessment and develop a training programfor PISU staff. 3.3 Phase three (2 months) During thisphase the consultant shall: Execute the training program designed in phasetwo;Assist the Department in the implementation and application of thesupervision framework and processes, and examination procedures manual by conducting pilot off-site analyses and on-siteexaminations; Conduct at least two pilot on-siteexaminations using the recommendedsupervision approach;Conduct a training workshop for staff in the Pension and InsuranceSupervision Department; and Conduct an awareness workshop for the pension industry on theapplication of the supervision framework. 4.0 Deliverables TheConsultant will be required to deliver on the following: An inception report within two weeks of concluding first phaseoutlining the findings, strengths, weaknesses, opportunities, and threats to supervision of pension. The objective of the project is to spur socio-economic growth in Malawi by improving health and livelihoods of the rural population through provision of sustainable water supply and improved sanitation in the districts of Rumphi, Nkhotakota, Ntcheu, Mangochi and Phalombe. In addition to increasing access to clean water and improved sanitation services in the project districts, the project aims to: (i) increase the resilience of water supply systems through rehabilitation and expansion and address sanitation and hygiene challenges. (ii) climate proof and ensure inclusive access to water supply and sanitation. (iii) support the empowerment of district councils and rural communities with particular emphasis on women and youth, monitoring and evaluation, and on enhancing sector reforms for governance and accountability of service delivery. 4. The specific objectives of the services under this assignment include: (i) Design and Construction Supervision of the Rehabilitation and Expansion Gravity Fed Systems include: a. To prepare detailed designs and bid documents for the rehabilitation and extension of the two (2) existing gravity fed piped water schemes in Phalombe district. b. Construction Supervision of the rehabilitation and expansion works. (ii) Construction Supervision of Boreholes in the District include: a. To provide the current and future water needs in the rural areas by development of groundwater resources through active participation of the community in all stages of the project. b. Perform all the necessary hydro geological studies for borehole siting. c. Supervise all the drilling, construction and testing operations and, report and analyse the information generated during the project. 5.
