The Bulgarian Energy Efficiency and Renewable Sources Fund (“BEERSF”, the “Fund”) was established in 2005. The contract with the existing Fund Manager expires in 2016 and pursuant to a decision of the BEERSF Management Board and as per art. 87 (1) and 88 of the Bulgarian Energy Efficiency Act a new fund manager is to be selected.
The Ministry of Energy of the Republic of Bulgaria (the “Ministry”) intends to use grant funds under Grant Agreement No. 003 (the “Grant”) from the Kozloduy International Decommissioning Support Fund (the “KIDSF”), administered by the European Bank for Reconstruction and Development, to engage a suitably qualified consultant to assist the Ministry in preparing and implementing a competitive procedure for the selection of a Fund Manager for BEERSF.
The scope of the assignment of the Consultant will include:
• Analysis of the appropriate legal framework under which the selection of a Fund Manager for BEERSF shall be implemented and recommendation of a particular type of procurement procedure;
• Determining the body that will implement the procurement process for the selection of the Fund Manager for BEERSF and will sign the Fund Management Agreement with the selected Fund Manager;

Competitive markets lie at the heart of EBRD's mandate to foster transition to open market oriented economies. An increase in competition leads to a more efficient resource allocation, higher levels of innovation, increased productivity, and ultimately to higher growth.
Bulgaria’s Commission for Protection on Competition (hereinafter the 'CPC' or the 'Client') was established in 1991 as an independent specialized state body to ensure the protection of competition and to create conditions for the development of competition and free initiative in the business sector, including through the exercise of control over the legality of the budget spending through the public procurement system and the granting of concessions.
According to the latest assessment published in the EBRD Transition Report, Bulgaria has an overall rating of 3 in relation to the quality of its competition policy regime, indicating significant scope for improvement especially on the enforcement side. Several aspects have been identified as requiring improvement and action from the CPC, including: a) the review of the leniency program b) the development of a systematic approach to market investigations in order to transform them in proper investigative tools; c) the need to upgrade the skills of the CPC employees; and d) the necessity to develop methodologies to assess ex-post the impact of the CPC's decisions, especially in the area of merger control.
Against this background, the Client has requested EBRD to provide technical assistance to strengthen its institutional capacity as a regulator by strengthening the skills and competencies of its officials and case handlers on competition law enforcement (the 'Project').
The Bank now proposes to engage a consulting firm or group of firms (the 'Consultant') to provide capacity building for the Client by strengthening the skills and competencies of its officials and case handlers on competition law enforcement through formal classroom-based training (the 'Assignment').
The Consultant shall be required to provide the following services:
a) Provision of econometric software including training;
b) Development of a training curriculum on (i) the enforcement of the rules on the abuse of superior bargaining power, (ii) ex-post evaluation of the effects of mergers control decisions, (iii) design of an effective approach towards sector inquiries, market monitoring, collecting data from publicly available sources and its assessment, and (iv) competition assessment in public procurement;
c) Delivery of classroom-based training for approximately 15-20 participants for an overall period of approximately 20 days; and
d) Delivery of a toolkit on ex-post mergers evaluation in order to provide the CPC PC with tools for verifying whether its decisions reach their objective and improve to improve its overall merger control policy.
While the Consultant will work closely with the Client, the contracting entity will be the Bank.

The Consultant must determine whether any VAT would be chargeable on the services and the basis for that determination, without taking into consideration the special status of the Bank as an IFI and state this to the Bank in their response to the Invitation for Expressions of Interest. To the extent that a Consultant incurs input VAT on goods and services purchased in connection with the provision of services (e.g. VAT on airline ticket) which is not otherwise recoverable by the consultant from the local tax authority, the gross cost to the consultant of such expenses shall be treated as a reimbursable expense.

a) the successful delivery of capacity building programmes of a comparable nature, scale and complexity to that required under this Assignment;

c) the successful dealing with antitrust cases in the capacity of economic/legal consultant or as case handler in a competition agency; and

The Consultant's expert team is expected to include key experts as follows:
Key Expert No 1 - Team Leader/Competition Economics Expert with preferably 10 years or more of previous professional experience in the field of economics of competition and competition law, preferably including market assessments; econometrics applied to competition law; assessment of single and collective dominance issues; ex-post evaluation of mergers. competition issues in public procurement markets;

The modernisation of radioactive waste management capacities to receive, process and store waste from decommissioning is one of the most important conditions for the success of the decommissioning programme of Kozloduy KNPP Units 1 to 4, which requires the upgrade of the Radioactive Waste Processing Plant (RAWPP) and Radioactive Waste (RAW) storage, handling and transport facilities (hereinafter called “the Facility”) at “Specialised Division RAW Kozloduy”.
State Enterprise Radioactive Waste (SERAW) intends to use proceeds from the KIDSF grant towards the Consultancy Services to support the upgrade of the Facility. It is envisaged that the assignment will include the following tasks:
- Development of the Technical Design for the upgrade of the RAWPP;
- Development of the Technical Design for the upgrade of the RAW Storage, handling and transport facilities;
- Update of Safety Analysis Report for the Facility;
- Support to the Client in establishing licensing requirements for the Facility through the Client’s interfaces with regulatory authorities and other public institutions.
The upgrade shall conform to the functionality and interfaces required for the successful decommissioning and dismantling of a Nuclear Power Plant.

This General Procurement Notice is an update of the General Procurement Notice (No. 8161-GPN-17149) published on EBRD web site on 29 January 2016.
Bulgartransgaz EAD (the "Employer") intends to use Grant proceeds provided by the Kozloduy International Decommissioning Support Fund ("KIDSF"), administrated by the European Bank for Reconstruction and Development (EBRD, "the Bank") under Grant Agreement No 057 and its own funds, to construct gas pipelines with a total length of 122 km to connect the municipalities of Svishtov, Pirdop, Panagiurishte, Bansko and Razlog to the national gas transmission network (the Project).
