The Bulgarian Energy Efficiency and Renewable Sources Fund (“BEERSF”, the “Fund”) was established in 2005. The contract with the existing Fund Manager expires in 2016 and pursuant to a decision of the BEERSF Management Board and as per art. 87 (1) and 88 of the Bulgarian Energy Efficiency Act a new fund manager is to be selected.

 

The Ministry of Energy of the Republic of Bulgaria (the “Ministry”) intends to use grant funds under Grant Agreement No. 003 (the “Grant”) from the Kozloduy International Decommissioning Support Fund (the “KIDSF”), administered by the European Bank for Reconstruction and Development, to engage a suitably qualified consultant to assist the Ministry in preparing and implementing a competitive procedure for the selection of a Fund Manager for BEERSF.

 

The scope of the assignment of the Consultant will include:

 

•    Analysis of the appropriate legal framework under which the selection of a Fund Manager for BEERSF shall be implemented and recommendation of a particular type of procurement procedure;

•    Determining the body that will implement the procurement process for the selection of the Fund Manager for BEERSF and will sign the Fund Management Agreement with the selected Fund Manager;

•    Elaboration of the full package of procurement documents for the selection of a Fund Manager, including a template for the Fund Management Agreement and support in their approval from all relevant authorities;

•    Assistance in the implementation of the procurement process for the selection of a Fund Manager for BEERSF;

•    Support in the negotiations, if any, with the selected Fund Manager and in the signature of the Fund Management Agreement.

 

The overall budget for the assignment is 15,000 Euro.

 

Selection of the Consultant will be subject to the Bank's Procurement Policies and Rules, Section 5.3 (a). The proceeds of the Grant will not be used for the purpose of any payment to persons or entities, of for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Purchaser's country.

Project Description:
Competitive markets lie at the heart of EBRD's mandate to foster transition to open market oriented economies. An increase in competition leads to a more efficient resource allocation, higher levels of innovation, increased productivity, and ultimately to higher growth.

Bulgaria’s Commission for Protection on Competition (hereinafter the 'CPC' or the 'Client') was established in 1991 as an independent specialized state body to ensure the protection of competition and to create conditions for the development of competition and free initiative in the business sector, including through the exercise of control over the legality of the budget spending through the public procurement system and the granting of concessions.

According to the latest assessment published in the EBRD Transition Report, Bulgaria has an overall rating of 3 in relation to the quality of its competition policy regime, indicating significant scope for improvement especially on the enforcement side. Several aspects have been identified as requiring improvement and action from the CPC, including: a) the review of the leniency program b) the development of a systematic approach to market investigations in order to transform them in proper investigative tools; c) the need to upgrade the skills of the CPC employees; and d) the necessity to develop methodologies to assess ex-post the impact of the CPC's decisions, especially in the area of merger control.

Against this background, the Client has requested EBRD to provide technical assistance to strengthen its institutional capacity as a regulator by strengthening the skills and competencies of its officials and case handlers on competition law enforcement (the 'Project').

Assignment Description:
The Bank now proposes to engage a consulting firm or group of firms (the 'Consultant') to provide capacity building for the Client by strengthening the skills and competencies of its officials and case handlers on competition law enforcement through formal classroom-based training (the 'Assignment').

The Consultant shall be required to provide the following services:
a) Provision of econometric software including training;
b) Development of a training curriculum on (i) the enforcement of the rules on the abuse of superior bargaining power, (ii) ex-post evaluation of the effects of mergers control decisions, (iii) design of an effective approach towards sector inquiries, market monitoring, collecting data from publicly available sources and its assessment, and (iv) competition assessment in public procurement;
c) Delivery of classroom-based training for approximately 15-20 participants for an overall period of approximately 20 days; and
d) Delivery of a toolkit on ex-post mergers evaluation in order to provide the CPC PC with tools for verifying whether its decisions reach their objective and improve to improve its overall merger control policy.

While the Consultant will work closely with the Client, the contracting entity will be the Bank.

Status of Selection Process:

Assignment Start Date and Duration:
The Assignment is expected to start in April 2017 and has an estimated overall duration of 18 months.

Cost Estimate for the Assignment:
EUR 148,000 (exclusive of VAT), inclusive of EUR 11,700 for the provision of software licenses and training materials. Subject to the availability of funding, the performance of the selected Consultant and the specific needs of the Client and the Bank, the Assignment may be extended beyond the current scope.

The Consultant must determine whether any VAT would be chargeable on the services and the basis for that determination, without taking into consideration the special status of the Bank as an IFI and state this to the Bank in their response to the Invitation for Expressions of Interest. To the extent that a Consultant incurs input VAT on goods and services purchased in connection with the provision of services (e.g. VAT on airline ticket) which is not otherwise recoverable by the consultant from the local tax authority, the gross cost to the consultant of such expenses shall be treated as a reimbursable expense.

It is expected that the Assignment will be funded by the EBRD Shareholder Special Fund. Please note that selection and contracting is subject to the availability of funding.

Consultant Profile:
Corporate services are required. The Consultant will be a firm or a group of firms with preferably previous project experience related to
a) the successful delivery of capacity building programmes of a comparable nature, scale and complexity to that required under this Assignment;
b) the successful implementation of empirical techniques for ex-post evaluation of mergers in the context of policy or research
c) the successful dealing with antitrust cases in the capacity of economic/legal consultant or as case handler in a competition agency; and
d) the successful delivery of policy advice (preferably within the context of capacity building projects) in the area of public procurement, in particular with reference to competition issues arising in the context of tender design and monitoring.

The Consultant's expert team is expected to include key experts as follows:

 Key Expert No 1 - Team Leader/Competition Economics Expert with preferably 10 years or more of previous professional experience in the field of economics of competition and competition law, preferably including market assessments; econometrics applied to competition law; assessment of single and collective dominance issues; ex-post evaluation of mergers. competition issues in public procurement markets;

 Key Expert No 2– Econometrician with preferably 10 years of previous professional experience in the field of econometrics; empirical industrial organisation; ex-post evaluation of merger decisions; empirical analysis of procurement markets; and

 Key Expert No 3 – Competition Law Expert with preferably 10 years or more of previous professional experience in the field of international competition law, preferably including assessment of single and collective dominance issues.
All Key Experts shall be fluent in written and spoken English. It is essential that the Consultant has access to members (e.g. an interpreter or a Key Expert) which can assist in communicating in Bulgarian.

Technical Criteria (100%)

Only those submissions which score 70% or more of the total marks available for the technical criteria will be eligible to have their financial proposals evaluated.

Financial Criterion (100%)
The lowest evaluated financial proposal (Fm) will be given the maximum financial score (Sf) of 100. The formula for determining the financial scores (Sf) of all other financial proposals will be calculated as following:

Sf = 100 x Fm/F, in which 'Sf' is the financial score, 'Fm' is the lowest price, and 'F' the price of the financial proposal under consideration.

Combined Technical and Financial Evaluation and Ranking
The weights given to the Technical (T) and Financial (P) Proposals are:
T = 85, and
P = 15

Submissions will be ranked according to their combined technical (St) and financial (Sf) scores using the weights (T=the weight given to the Technical Proposal; P = the weight given to the Financial Proposal; T+P=1) as following: S=St x T% + Sf x P%.

This Invitation for Expressions of Interest follows the updated General Procurement Notice for this project published in Procurement Opportunities, on the EBRD website dated 20th January 2017.

Background:

The modernisation of radioactive waste management capacities to receive, process and store waste from decommissioning is one of the most important conditions for the success of the decommissioning programme of Kozloduy KNPP Units 1 to 4, which requires the upgrade of the Radioactive Waste Processing Plant (RAWPP) and Radioactive Waste (RAW) storage, handling and transport facilities (hereinafter called “the Facility”) at “Specialised Division RAW Kozloduy”.

Assignment description:

State Enterprise Radioactive Waste (SERAW) intends to use proceeds from the KIDSF grant towards the Consultancy Services to support the upgrade of the Facility. It is envisaged that the assignment will include the following tasks:

  1. Development of the Technical Design for the upgrade of the RAWPP;
  2. Development of the Technical Design for the upgrade of the RAW Storage, handling and transport facilities;
  3. Update of Safety Analysis Report for the Facility;
  4. Support to the Client in establishing licensing requirements for the Facility through the Client’s interfaces with regulatory authorities and other public institutions.

The upgrade shall conform to the functionality and interfaces required for the successful decommissioning and dismantling of a Nuclear Power Plant.

Status of the Selection Process: Interested Consultants are hereby invited to submit expressions of interest.

Assignment Start Date and Duration: The assignment is anticipated to start in August 2017 and is expected to last for approximately 10 (ten) months.

Maximum budget available for the assignment: EUR 2,200,000 (Two Million, two hundred thousand Euros) (Exclusive of VAT) available for the assignment and shall be free from any and all taxes, customs duties or other fees or mandatory payments arising in, or as a result of, performance of services in the country of the Assignment (Bulgaria).

Funding source: The contract will be financed by a Grant from the Kozloduy International Decommissioning Support Fund (KIDSF).

  • Preparation of Technical Design documentation related to processing and/or treatment and/or conditioning and/or handling and/or transportation and/or storage, and/or management and/or other tasks for Radioactive Waste (RAW) and/or Radioactive Materials (RAM);
  • Development of detailed layout models for installations, structures and equipment to be deployed within Nuclear Power Plants;
  • Preparation of Technical Design documentation required for modifications and/or installation and/or construction activities to be undertaken inside of the Controlled Areas of Nuclear Power Plants;
  • Development of methodology and procedures for Classification and Management of RAM required for segregation and streaming of primary and secondary waste arising from dismantling operations;
  • Knowledge of Bulgarian and/or European rules and regulations, applicable to Nuclear facilities;
  • Development of Health and Safety procedures related to Nuclear facilities;
  • Development of licensing procedures related to Nuclear facilities;
  • Development of Safety Analysis Documentation.

Construction of three gas transmission pipelines in Bulgaria

This General Procurement Notice is an update of the General Procurement Notice (No. 8161-GPN-17149) published on EBRD web site on 29 January 2016.

Bulgartransgaz EAD (the "Employer") intends to use Grant proceeds provided by the Kozloduy International Decommissioning Support Fund ("KIDSF"), administrated by the European Bank for Reconstruction and Development (EBRD, "the Bank") under Grant Agreement No 057 and its own funds, to construct gas pipelines with a total length of 122 km to connect the municipalities of Svishtov, Pirdop, Panagiurishte, Bansko and Razlog to the national gas transmission network (the Project).

The Project will require procurement of goods, works and services as follows:

1. Gas transmission pipeline to Svishtov

Scope - supply of equipment, installation, construction and commissioning of a high pressure gas transmission pipeline, automated gas regulation station (AGRS) to the town of Svishtov and auxiliary facilities.

2. Gas transmission pipeline to Panagiurishte and Pirdop

Scope - supply of equipment, installation, construction and commissioning of a high pressure gas transmission pipeline, AGRS to the town of Panagiurishte, AGRS to the town of Pirdop and auxiliary facilities.

3. Gas transmission pipeline to Bansko and Razlog

Scope - supply of equipment, installation, construction and commissioning of a high pressure gas transmission pipeline, AGRS to the town of Razlog, AGRS to the town of Bansko and auxiliary facilities.

4. Consulting services for design and of a Project Management Unit Consultant were already procured within the scope of the Grant Agreement.

The total budget for the Project is 21,8 million EUR, 50% will be funded by KIDSF and 50% by Bulgartransgaz EAD.

Procurement will commence in the last quarter of 2017.

Contracts implementation is expected to take between 12 and 30 calendar months, followed by a Defects Notification Period.

Contracts to be financed with the proceeds of the KIDSF will be subject to the Bank’s Procurement Policies and Rules and will be open to firms from any country.

The proceeds of the Grant shall not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law or official regulation of the Employer's country.
