Invitation for Prequalification of Tenderers
Capital Development and Ore Winding Complex Installation Contract
This Invitation for Prequalification follows the General Procurement Notice for this project, which was published on the EBRD website, Project Procurement Notices (http://www.ebrd.com/work-with-us/procurement.html) section on 3 March 2016.
ShalkiyaZinc LTD JSC (the "Client") has requested the European Bank for Reconstruction and Development (the "Bank") to grant a loan and intends to spend part of the proceeds of the loan to fund the project named "Commercial Mining of Polymetallic Ores from Shalkiya Deposit in Kyzylorda Region of the Republic of Kazakhstan Featuring Construction of Enrichment Factory".
The Client intends prequalifying companies and consortia to tender for the following contract to be funded from part of the proceeds of the loan - the Contract on Capital Development, Construction and Assembly Work on Mine Facilities (the "Contract"). The scope of capital development work under the Contract includes:
The Client is currently carrying out the procurement procedure under the Project for the separate Turnkey Engineering, Procurement and Construction Contract for Shalkiya Lead-Zinc Project Enrichment Factory in Kyzylorda Region (the “EPC Contract”, prequalification identification number: 8268-PRE-48347). It is expected that the works under the Contract will be closely interrelated with EPC Contract.
The work is to be performed on the site of the Shalkiya polymetallic ores deposit in Kyzylorda Region, Republic of Kazakhstan.

Prequalification and tendering for contracts to be financed with the proceeds of a loan from the Bank is open to companies and associations of companies (consortia) from any country.

The request must be accompanied by a confidentiality undertaking in the form attached to this Invitation for Prequalification of Tenderers and signed by the applicant. In the absence of a confidentiality undertaking the prequalification documents will not be furnished.
In the request for information please indicate if you are willing and ready to participate in the clarification meeting which is planned to be held in [Astana].
Prequalification applications must be duly completed and delivered to: 7 Al-Farabi Avenue, Block 4A, Office 38, Almaty, 050000, Republic of Kazakhstan, not later than 11:00 AM (Almaty time) on March 3, 2017.
Documents which are received after this deadline may be rejected and returned unopened to the applicant.

We hereby represent and warrant that the information received by us from ShalkiyaZinc LTD JSC (the “Client”) as part of the prequalification of tenderers for the award of the Contract on Capital Development, Construction and Assembly Work on Mine Facilities for the project Commercial Mining of Polymetallic Ores from Shalkiya Deposit in Kyzylorda Region of the Republic of Kazakhstan Featuring Construction of Enrichment Factory (the “Prequalification”), and as part of the single-stage tender for the said project (the “Tender”), and identified as confidential information by the Client (“Confidential Information”) shall be treated by us as confidential information protected under the laws of the Republic of Kazakhstan.
We hereby represent and warrant that Confidential Information will be used solely for the purposes of participating in Prequalification and/or Tender, and undertake to ensure the security of Confidential Information and not to disclose it to third parties. Confidential Information may be disclosed to a limited number of our officers, executives, employees and consultants (who are hereinafter referred to collectively as “Representatives”) for whom the possession of such Confidential Information is required for the purposes of our participation in Prequalification and/or Tender and who have assumed obligation, to the extent not less than that as required by this confidentiality undertaking, to secure Confidential Information and refrain from disclosing it.
We shall cause our Representatives to abide by all of the confidentiality provisions and shall be liable for any breach of these provisions by any of our Representatives. We shall also maintain a record of the Representatives whom Confidential Information has been disclosed to.
We therefore agree that the Client shall be entitled to seek any remedy available to it on the basis of this confidentiality undertaking, the laws or any other basis in the event of any breach of the above provisions by us.

The Government of Kazakhstan applied to European Bank for Reconstruction and Development (EBRD) for a loan to support restoration of irrigated lands in Aktobe, Zhambyl and South Kazakhstan Regions (the Project) by rehabilitation of water supply infrastructure in these regions. Rehabilitation will mainly include replacing of outdated water canals in the areas where infrastructure exists to increase water supply efficiency and reduce leakages, as well as construction of new water canals in the areas where water supply infrastructure does not exist.
The Project, which has a total estimated cost of USD 180 million equivalent, will be implemented by the Republican State Enterprise "Kazvodkhoz" and will require the procurement of the following goods, works and services:
Selection of General Management Company is expected to begin in the Ist quarter of 2017, while tendering for other contracts - in the 3rd - 4th quarter of 2017.
Contracts to be financed with the proceeds of a loan from the Bank will be subject to the Bank's Procurement Policies and Rules and will be open to firms from any country. The proceeds of the Bank's loan will not be used for the purpose of any payment to persons or entities, of for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Purchaser's country.
