GENERAL PROCUREMENT NOTICE

This notice is an update to the General Procurement Notice 7698-GPN-45725 for this project, published on the EBRD website on 17 September 2014.

 

State Communal Enterprise Kyzylorda Su Zhuyesi (the “Company”), a water distribution and wastewater treatment company in the city of Kyzylorda (the “City”), entirely owned by the City Akimat, has applied for a loan from the European Bank for Reconstruction and Development to finance rehabilitation and upgrade of the water and wastewater system in the City. The proposed project, which has a total estimated cost of up to USD 10 million equivalent, will require the procurement of the following goods, works and services:

 

           SCADA, including water and pressure meters

           Supply and installation of equipment for boreholes

           Construction of water supply softening facilities

           Rehabilitation of sewer from WWPS-12 to WWPS-1

           Modernization of WWPSs

           Construction of Main Interception WWPS

           Supply of equipment

           Corporate Development Support

 

Tendering for the above contracts is expected to begin in the in the first quarter of 2016.

 

Contracts to be financed with the proceeds of a loan from the Bank will be subject to the Bank’s Procurement Policies and Rules and will be open to firms from any country. Kurty-Burylbaytal Road Project Extension

The Invitation for Expressions of Interest follows the General Procurement Notice for this project published in Procurement Opportunities, on the EBRD website on 3rd October 2016.

JSC NC “KazAvtoZhol” (the Employer, the client) intends using the proceeds of the loan towards the cost of “Kurty - Burylbaital” Road Reconstruction Project under “Centre - South” Corridor where the services of the Construction Supervision Consultant are required.

The Employer invites expressions of interest from suitably qualified firms who are interested in providing assistance to the Employer to facilitate the timely and effective implementation of the Project by advising the Employer on the administration of the EBRD-funded Contract/s with due diligence and by carrying out the duties of the Engineer assigned to him in the Contract/s which will be a re-measurement unit rate contract based on FIDIC Conditions of Contract for Construction, MDB Harmonized edition, 2010. The Consultant shall exercise the authority attributable to the Engineer, as specified in or necessarily implied from the Contract/s, to ensure timely, satisfactory completion of the Works in accordance with the Contract/s. The works on following section are considered:

 

(i)         Km 2152 - 2214  Reconstruction of the section of the road “Kurty - Burylbaital” 62 km long with four lanes,  asphalt concrete paving according to I B category standards.

The assignment is expected to start in beginning of 2017 and last about 39-months plus 24-months covering defects liability period plus several months for the Performance Certificate issue and other closing activities.

In order to successfully implement the assignment, it is envisaged that the consultant’s team will consist of the following key experts:

•    1 (one) Project Manager/ Resident Engineer
•    1 (one) Road Engineer
•    1 (one) Bridges and Artificial Structures Engineer
•    1 (one) Quality and Materials Engineer
•    1 (one) Environmental and Social expert

 

Also, the Consultant shall envisage the group of following non-key technical support staff:

•    1 (one) Land Surveyor
•    1 (one) Quantity Surveyor
•    1 (one) Laboratory Assistant
•    1 (one) Office Manager
•    2 (two) Translators/Interpreters

 

Eligibility: Procurement will be open for all the Consultants except those restricted in the EBRD’s list of ineligible entities. The proceeds of the loan shall not be used for the purpose of any payment to persons or entities or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations and the Client’s Country prohibitions.

Procurement of the consultancy services will be conducted in accordance with the EBRD’s Procurement Policies and Rules. The consultants will be selected under Quality-and Cost-Based Selection (QCBS).

The shortlist of qualified firms will be prepared on the response to this invitation, after which short-listed firms will be invited to submit their proposals.

If the Consultant has been found by a judicial process or other official enquiry to have engaged in corrupt or fraudulent practices, details of the basis for the outcome of such process or enquiry shall be provided with the expression of interest.

The Employer reserves the right not to shortlist consulting firms that have been found to have engaged in corrupt or fraudulent practices regardless of the results of technical evaluation of the expressions of interest.

In order to determine the capability and experience of consulting firms seeking to be shortlisted, the information submitted shall include the following:

• General information about the company (date of creation, company profile, the number of staff);

• The description of experience with reflection of experience of similar tasks for the last five years (i.e. 2012-2016), with indication of works location (country). Information for each project shall include, at least, the following:

- name of the project, location, tasks and short description of project works;

- form of the contract applied during construction/reconstruction of road and its condition (e.g. FIDIC, NEC, etc.);

- role of the company in the contract;

- availability of any partner or mother companies and their roles;

- commencement and completion dates;

- project cost, length of road, technical category of the road;

- Employer and source of financing of the project;

 -functions and tasks including applicable to national and/or international codes and standards, certificates

In case of omission of any of the above project features, the project may be dismissed during evaluation.

Kostanay Water

State Communal Enterprise Kostanay Su (the "Company"), a municipal water distribution and wastewater treatment utility of the city of Kostanay (the "City") in the Republic of Kazakhstan, entirely owned by the City Akimat, has applied for a loan from the European Bank for Reconstruction and Development to finance to support the rehabilitation and upgrade of the water and wastewater infrastructure in the City.

Kurty-Burylbaital Road Reconstruction Project Extension

This Invitation for Prequalification follows the General Procurement Notice for this project which was published on the EBRD website, Project Procurement Notices (http://www.ebrd.com/pages/workingwithus/procurement/project.shtml) on October 03, 2016.

Joint Stock Company “National Company “KazautoZhol” of the Republic of Kazakhstan, hereinafter referred to as “the Client”, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development, hereinafter referred to as “the Bank”, towards the cost of “Kurty-Burylbaital” Road Reconstruction Project under “Center-South” Corridor.

The Client intends prequalifying firms and joint ventures to tender for the following contract, hereinafter referred to as “the Contract”, to be funded from part of the proceeds of the loan:

  • Contract EBRD/CW-02/2016: km 2152-2214 “Kurty-Burylbaital” Road

Completion period is expected to be 39 months with further Defect Notification Period of 24 months.

To be prequalified for tendering for the Contract, the applicant must demonstrate to the Client that it substantially satisfies the requirements regarding experience, personnel, equipment, financial position and litigation history as detailed in the Prequalification documents and briefly summarised below:

General Experience:

The applicant shall have an average annual turnover as a contractor over the last 5 years (i.e. 2011-2015) of equivalent of USD 65 mln. The turnover value in other currencies than the defined currency should be recalculated into that currency based on the exchange rate as of the 1st of July of each year reported, as set by National Bank of Republic of Kazakhstan.

Specific Experience:

  1. successful experience as a contractor (prime or subcontractor) in the execution of at least 2 contracts of a magnitude comparable to the proposed contract within the last 5 years. For assessment purposes the values of the referred contracts shall be not less than the equivalent of USD 55 million; 
  2. the applicant shall have acted as a main contractor on 2 contracts of a similar magnitude. For assessment purposes the values of the referred contracts shall be not less than the equivalent of USD 55 million;
  3. successful experience as a contractor (prime or subcontractor) in the execution of at least 2 contracts of a nature and complexity comparable to the proposed contract within the last 5 years. For assessment purposes the referred contracts shall include reconstruction or construction of asphalt-concrete roads.

The following specific operations and works experience shall be demonstrated:

 

  • Asphalt concrete paving of 420 000 m2 per year;
  • Earthworks (fill-excavation) – 1 100 000 m3 per year
  • One bridge – 111 m length.

 

Financial Position:

The applicant shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of three months, estimated as USD 10 mln, taking into account the applicant's commitments in other contracts.

Prequalification and tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms and joint ventures of firms from any country and is governed by the EBRD Procurement Policies and Rules.. The proceeds of the Bank's loan will not be used for the purpose of any payment to persons or entities, of for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Purchaser's/Employer's country.

Project Description:
The European Bank for Reconstruction and Development (the “EBRD” or the “Bank”) is considering lending to JSC “Fund for Housing Development” (the “Fund”, the "Company", the “Client” or the “Borrower”), wholly owned by the Government of Kazakhstan (the “GOK”) to co-finance the National programme for installation of heat and hot water metering devices in district heating facilities in Kazakhstan (the “Programme”). The second direction of the Fund's activity is a programme for Individual Heat Sub-stations (“IHS") installation ("IHS Programme") and Automated meter reading and control system for electricity installation.

The Programme targets any eligible local heat supply company, including those located in small towns. Equipment under the Programme will be leased by the Fund to local heat supply companies for use in residential buildings. The Fund will oversee arrangements with contractors for the installation of equipment at DH utilities in multiple cities in Kazakhstan.

Assignment Description:
The Fund now intends to retain a consulting company (the “Consultant”) to support the Fund to set up and oversee the Project Implementation Unit in procurement and installation of metering devices as a part of Project implementation (the “Assignment”).

The expected outcome of the Assignment is the successful procurement of works and goods in accordance with the EBRD’s Procurement Policies and Rules and the successful and timely completion of the Project.
 
The Consultant shall perform, inter alia, the following key activities:
i) Assist the Fund in establishment of the Project Implementation Unit (“PIU”) and development of its operating procedures;
ii) Assist the Fund in capacity building necessary to deal with implementation of the Programme in accordance with best practice and educate the personnel of the Fund;
iii) Support the Fund in all aspects of the project implementation, including procurement (tendering, purchase and installation);
iv) Provide timely recommendations and report to the Fund on the contract administration process;
v) Provide necessary support to the Fund in project monitoring and reporting to the Bank.

Status of Selection Process: Interested firms or group of firms are hereby invited to submit expressions of interest.

Assignment Start Date and Duration: The Assignment is expected to start in Q1 2017 and has an estimated overall duration of 24 months.

Cost Estimate for the Assignment: EUR 150,000 (exclusive of VAT).
The Consultant must determine whether any indirect taxes/VAT are chargeable on the proposed services and state the basis for such. If any indirect taxes/VAT are payable, the Client will have to pay indirect taxes/VAT element to the services directly to the Consultant unless otherwise agreed.

Funding Source: It is anticipated that the Assignment will be funded by EBRD Shareholder Special Fund. Please note that selection and contracting will be subject to the availability of funding.

Eligibility: There are no eligibility criteria

Consultant Profile: Corporate services are required. The Consultant will be a firm or a group of firms with previous project experience related to:

1. provision of project implementation support of a comparable nature, scale and complexity to the Assignment, including procurement and installation of heat meters in the district heating sector, in Eastern Europe and/or former CIS countries and with similar climatic conditions;

2. projects involving the procurement policies and rules of international financial institutions (such as the EBRD, World Bank or others) as applicable for construction and Supply & Installation projects.

The Consultant’s expert team is expected to include key experts as follows:

a Key Expert No 1: Team Leader with preferably 10 years of professional experience in comparable assignments in the district heating sector in in Eastern Europe and/or the CIS countries and with similar climatic conditions; and experience of working with IFIs (or similar);
 
b Key Expert No 2: Local Project Manager - Installation Supervisor with preferably 5 years of previous professional experience of installation of heat meters gained in countries with conditions similar to Kazakhstan;
 
c. Key Expert No 3: IFI Procurement and Contracts expert with preferably 5 years or more of previous professional experience in the successful implementation of similar assignments and have good knowledge of a good knowledge of procedures and rules of procurement of international financial institutions, such as the EBRD, World Bank or other IFIs, knowledge of FIDIC and/or World Bank/EBRD Supply and Installation contractual arrangements;

d. Key Expert No 4: Finance and Disbursement expert with preferably 5 years or more of previous professional experience in the successful implementation of similar assignments and have a good knowledge of requirements of Kazakh legislation concerning construction, financial, accounting and disbursement issues;

e. Key Experts No 5 and 6: International and Local District Heating experts with preferably 5 years or more of previous professional experience in the successful implementation of similar assignments in district heating sector;

g. Key Expert No 7: Environmental, Health and Safety and Social specialist with preferably 5 years or more of previous professional experience in the successful implementation of comparable assignments and with demonstrated knowledge of the environmental and social standards of the EBRD or other comparable institutions;

All key experts shall be fluent in written and spoken English. It is essential that the Consultant’s team contains key experts fluent in Russian. If some of key experts do not speak Russian, the consultant should demonstrate that they arranged for high quality translation.

Non-key experts are expected to include junior technical, legal and environmental experts.

Submission Requirements: In order to determine the capability and experience of Consultants seeking to be selected the information submitted should include the following:

1. Company/group of firms’ profile, organisation and staffing (max. 2-4 pages).

2. Details of previous project experience or similar assignments particularly undertaken in the previous five years, including information on contract value, contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided (if different from duration) , main activities, objectives.

3. Proposed approach, work plan and methodology.

4. CVs of key experts who could carry out the Assignment detailing qualifications, experience in similar assignments, particularly assignments undertaken in the previous five years, including information on contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided, assignment budget, main activities, objectives.

5. Financial proposal presented in the breakdown of costs format using the template via the following link.

The above information shall not exceed 25 pages (excluding CVs, Consultant Declaration, Contact Sheet and Financial Proposal).

The expression of interest (including Section 1 – 4 and 6 of the Submission Requirements above) WITHOUT THE FINANCIAL PROPOSAL should be submitted, in English and Russian via clearly named email (pdf) to the Client’s contact person, to reach the Client not later than the closing date and time. One additional copy shall reach the Bank’s contact person by the same due date. The document shall be one file (pdf). The Client reserves the right to reject applications of firms submitting more than one file. Only if any limitation on the permissible file size is exceeded, the Consultant may split the expression of interest into further files.

In a separate email, the Financial Proposals should be submitted, in English and Russian via clearly named email (pdf) to the Bank’s contact person only, to reach the Bank not later than the closing date and time.

Please note that a breach of this submission procedure may lead to exclusion of the selection process.

Important Notes:
1. The selection will normally be made from responses to this notification only. The highest-ranked Consultant will be selected from a shortlist and be invited to negotiate the contract, subject to availability of funding.

2. The evaluation criteria for the technical proposals are as follows:

(a) Firm’s experience in provision of project implementation support of a comparable nature, scale and complexity to the Assignment, including procurement and installation of heat meters in the district heating sector, in Eastern Europe and/or former CIS countries and with similar climatic conditions;– 15%

(b) Firm’s experience in projects involving the procurement policies and rules of international financial institutions (such as the EBRD, World Bank or others) as applicable for construction and Supply & Installation projects - 15%

(c) Proposed approach to the assignment, work plan and methodology - 20%

(d) Proposed team of key experts –40%

(e) Availability of junior staff, knowledge of Russian language and offices in Kazakhstan– 10%

The minimum technical score (St) required to pass is:  80.        

Please note that only the Financial Proposals from Consultants passing the minimum technical score (St) will be opened.

The lowest evaluated Financial Proposal (Fm) is given the maximum financial score (Sf) of 100.

The formula for determining the financial scores (Sf) of all other Proposals is calculated as following:

Sf = 100 x Fm/ F, in which “Sf” is the financial score, “Fm” is the lowest price, and “F” the price of the proposal under consideration.

The weights given to the Technical (T) and Financial (P) Proposals are:
T = 85 and
P = 15

Proposals are ranked according to their combined technical (St) and financial (Sf) scores using the weights (T = the weight given to the Technical Proposal; P = the weight given to the Financial Proposal; T + P = 1) as following:  S = St x T% + Sf x P%.

3. The Consultant implementing EBRD assignment “Kazakhstan - Heat Meters - Technical, Procurement and Environmental and Social Study” shall not be eligible to be awarded the assignment subject to this Procurement Notice.

 

Bozoi Gas Storage Facility

Intergas Central Asia JSC (ICA) is a 100% subsidiary of KazTransGas JSC (KTG), the national gas pipeline operator fully owned by Samruk-Kazyna via NC KazMunayGas.

ICA intends to use the loan proceeds in the amount of up to EUR 245 mln equivalent (or circa KZT 93 bln) from the European Bank for Reconstruction and Development for partial refinancing of its existing obligations and financing the ongoing capital expenditures programme, including the modernization of the Bozoi underground gas storage facility.

The  main objectives of the modernization project is to increase the volume of gas storage, improve significantly the flexibility and safety of the operations, reduce the operation and maintenance costs including gas losses and consequently enhance the security of natural gas supplies to the southern region of Kazakhstan. The proposed project has a total estimated cost of about KZT 37.3 Bln (EUR 96 Mln equivalent), and will require the procurement of the following goods, works and services;

  • Dismantle of a number of old, dangerous and inefficient wells,
  • Modernise a number of existing wells in order to improve safety and operational flexibility, and 
  • Drill and construction of a number of new wells at selected positions of the project site;
  • Capital overhaul and/or replacement of surface equipment of the gas gathering stations, including flow lines and separators, shut-off valves of gas collection points through supply and Installation of modern pipeline systems and auxiliaries;
  • Consulting Services for Procurement Support (potential services)

The procurement is expected to be initiated during 4th quarter of 2016.

KazTransGas Aimak JSC ("Aimak") intends using the proceeds of a loan from the European Bank for Reconstruction and Development (EBRD) to upgrade and expand distribution networks in several key regions of its operations where it serves households and industrial customers.

The Project will consist of two sub-projects to be implemented in the Aktobe and Mangistau oblasts to be implemented in 2016 to 2018. The investment programme provides for (i) extension of the gas network to  several regional administrative centres, primarily in the Aktobe region, with the installation of modern pipeline systems and auxiliaries; (ii) reconstruction and modernisation of existing distribution networks in both oblasts that will include, inter alia, the upgrade of existing, and construction of additional, pressure reduction and metering stations (AGRS) and automatic control systems as well as the replacement of old carbon steel piping with new polyethylene pipes and improvement of the losses monitoring and reduction systems.
 

The total estimated cost of all "Aimak" projects is up to EUR 220 million equivalent, out of which EBRD intends to provide about approximately Euro 125 million equivalent, and will require the procurement of the following goods, works and services for:

  • Supply and Installation of modern pipeline systems and auxiliaries (primarily in Aktobe region)
  • Reconstruction works and modernisation of existing distribution networks (Aktobe and Mangistau oblasts)
  • Consulting Services to support the Client’ Project Implementation Unit (PIU)
  • Consulting Services for the development of the methodology for calculation of gas distribution tariff based on best available international practices

The procurement is expected to be initiated during 1st and/or 2nd quarter 2016.

Contracts to be financed with the proceeds of a loan from the Bank will be subject to the Bank's Procurement Policies and Rules and will be open to firms from any country. The proceeds of the Bank's loan will not be used for the purpose of any payment to persons or entities, for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Purchaser's country.

Rehabilitation of Sewage Networks

This Invitation for Tenders follows the General Procurement Notice No. 8077-GPN-47570 for this project which was published in Procurement Opportunities on the EBRD website www.ebrd.com November 19, 2015.

Joint Stock Company “Akbulak” hereinafter referred to as the Employer, intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of Aktobe Water Project.

The Employer now invites sealed tenders from Сontractors for the contract AWP-6, “Rehabilitation of Sewage Networks” to be funded from the proceeds of the loan.

The Project is implemented on the territory of Aktobe City, Republic of the Kazakhstan.

In general, the scope of basic works of these Contracts shall include:

  • Rehabilitation of gravity sewage collector D500mm;
  • Rehabilitation of gravity sewage collector D300mm;
  • Rehabilitation of gravity sewage system D160mm, 225mm, 280mm.

The estimated completion time under the Contract is 540 days.

To be qualified for award, the Tenderer shall meet the following qualification criteria as a minimum:

  1. The Tenderer shall demonstrate that it has successful experience as prime contractor in the execution of at least 1 (one) project of a nature and complexity comparable to the proposed contract within the last 5 (five) years.
  2. The Tenderer shall demonstrate experience in the execution of at least 2 (two) contracts within the last 5 (five) years, that have been successfully completed and that are similar to the proposed Works.
  3. The Tenderer shall have an average annual turnover as prime contractor (defined as billing for works in progress and completed) over the last 3 (three) years not less than KZT 680,000,000 (six hundred eighty million) equivalent.
  4. The Tenderer shall demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, sufficient to meet the construction cash flow for the contract for a period of 3 (three) months, estimated as not less than KZT 115,000,000 (one hundred fifteen million) equivalent, taking into account the Tenderer's commitments for other contracts.
  5. The Tenderer shall submit balance sheets audited or supported by the documents issued by tax authorities of the tenderer’s country of origin for the last three (3) years and must demonstrate the soundness of the Tenderer's financial position, showing long-term profitability.  
  6. The Tenderer shall be certified for quality standard ISO 9001 (or equivalent) or shall submit his own quality assurance plan to demonstrate quality assurance procedures, which shall be applied for the execution of works under the Contract.

Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from any country. The proceeds of the Bank's loan will not be used for the purpose of any payment to persons or entities, of for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.

Background: The Enhanced Partnership Water and Wastewater Infrastructure Modernization Framework and the District Heating Modernization Framework (the "Frameworks") are an integral part of the Enhanced Partnership Framework Arrangement ("EPFA") signed between the European Bank for Reconstruction and Development (the "EBRD" or the "Bank") and the Government of Kazakhstan ("GoK").

In order to increase efficiency of projects implementation , the Bank has arranged a packaged TC approach that would support EPFA co-financed sub-projects in Kazakhstan in water and wastewater and district heating sectors and to launch a Project Implementation Unit Support (“PIU”) Framework (the “PIU Framework”) which is one of the key elements of technical cooperation under any investment to support the companies in all aspects of project implementation in accordance with the best practices and following EBRD’s Procurement Policies and Rules (“PP&Rs).
The beneficiaries of the PIU Framework are expected to be municipal water/wastewater and district heating enterprises (each, the “Company” or the “Beneficiary”), wholly owned by the respective city or region (each, the “City”).
Assignment Description: The EBRD is now seeking to pre-shortlist consultants for the purpose of inclusion in the lists of Preferred Consultants comprising up to eight firms each, one for the water and wastewater sector, and the other for the district heating sector (the “Consultants”) to support the Beneficiaries in the project implementation during the 2017-2020 period (the “Framework Assignments”).
The firms pre-shortlisted by the EBRD will be eligible for participation in the next stage of consultant selection – evaluation of proposals for specific assignments - to be managed by the EBRD clients. The selected Consultants will support the Beneficiaries in implementing the projects over the 2017-2020 period. The Preferred Consultants shortlist would be refreshed every 1-2 years depending on demand to ensure a competitive approach is maintained.

NOTE: This Invitation for Expressions of Interest is for the Water and Wastewater Sector.

For each individual PIU assignment, a secondary competition will be launched by the Beneficiaries, whereby the EBRD clients will select and engage the Consultants following evaluation of proposals received from the pre-selected Preferred Consultants.

Consultants will be engaged for the individual assignments in accordance with the EBRD’s Procurement Policies and Rules (“PP&Rs”). The Bank, on behalf of the Beneficiary, may send to some or all consultant(s) from the Preferred Consultants list terms of reference for the individual assignments. Terms of reference will include a description of the tasks to be performed, time-schedules and reporting instructions. Expert with preferably 10 years or more of previous professional experience in similar projects gained in countries with comparable conditions to Kazakhstan and have a good knowledge of procedures and rules of procurement of international financial institutions, such as the World Bank, ADB or EBRD.
