Project Description:
Business inspections in Serbia lack overall coordination, integration, standardisation, and oversight. For this reason in April 2015 the Serbian Parliament adopted the new umbrella Law on Inspection Oversight (the 'Inspections Law') and established an inter-ministerial coordination body, the Coordination Commission for Inspections Reform (the 'Coordination Commission'), to coordinate the Inspections Reform Action Plan. 

Under Article 12 of the Inspections Law, the Ministry of Public Administration and Local Self-Government ('MPALSG' or the 'Client') is required to establish a 'Support Division' to support the Coordination Commission.

The MPALSG has now requested the EBRD to provide technical assistance for the establishment and operation of the Support Division by providing funding for the professional staff required to ensure its effective functioning.

Assignment Description:
The Client now intends to retain a consulting firm or group of firms (the 'Consultant') to provide a team of qualified experts who will establish the Support Division to the Coordination Commission and will facilitate the implementation of the Inspections Law across the 39 different inspectorates and 12 ministries involved (the 'Assignment').

The expected outcome of this Assignment is the implementation of the Inspections Reform Action Plan within the potential three years of operation of the Support Division. 

The selected Consultant will support the Coordination Commission and a number of sectoral working groups providing advice and facilitating the implementation of the initiatives and decisions of the two bodies of the Coordination Commission. The Consultant will provide the following deliverables and indicators of achievement by the end of the Assignment:

(i) Contribute to the harmonization of the sectoral legislation with the umbrella Law on Inspection through the delivery of at least 5 (five) comments and opinion notes to the Coordination Commission;
(ii) Participate in designing at least 1 (one) training and 1 (one) curriculum for the professional development of the inspectors;
(iii) Deliver preparatory analysis and documents for at least 7 (seven) meetings of the Coordination Commission; and
(iv) Support the implementation of the unified inspections information system (e-Inspector) through the organisation of at least 4 (four) focus groups in cooperation with the MOPALG and the vendor of the system; and
(v) Support the Coordination Commission in drafting 3 (three) quarterly progress reports to the MPOLAG on the status of the implementation of the Inspections Law.

The Consultant will be responsible for the quality and timeliness of work and deliverables to the MPALSG.

The Consultant will be provided for the duration of the Assignment with furnished office accommodation at the Client's offices in Belgrade free of charge.

Status of Selection Process:
Interested firms or group of firms are hereby invited to send submissions.

Assignment Start Date and Duration:
The Assignment is expected to start in early February 2017 for an initial duration of 12 months. Subject to the availability of funding, the performance of the selected Consultant and the specific needs of the Client and the Bank, the Assignment may be extended on an annual basis up to a total maximum of 36 months.

Cost Estimate for the Assignment:
EUR 84,000 (exclusive of VAT) for the initial 12 months (up maximum of EUR 252,000 if the assignment is extended up to 36 months).
The Consultant must determine whether any indirect taxes/VAT are chargeable on the proposed services and state the basis for such. If any indirect taxes/VAT are payable, the Client will have to pay indirect taxes/VAT element to the services directly to the Consultant unless otherwise agreed.

Funding Source:
EBRD Shareholder Special Fund. Selection and contracting is subject to the availability of funding.

Eligibility:
There are no eligibility restrictions.

Consultant Profile:
Corporate services are required. The Consultant will be a firm or a group of firms with preferably previous project experience related to the successful provision of similar services in assignments of a comparable nature, scale and complexity.

The Consultant's expert team is expected to include key experts as follows:

Key Expert No. 1: Head of Division (Senior Advisor) with:
• University degree (Bachelor's degree or higher);
• Preferably seven  years or more of professional experience at management position(s) in the area of inspection oversight or in areas of comparable nature;
• Professional experience in leading a team on one or several projects of a comparable nature will be considered as an advantage;
• Fluency in written and spoken English and Serbian.

Key Expert No. 2: Coordination Advisor (Independent Advisor) with:
• University degree (Bachelor's degree or higher); 
• Preferably five years or more of professional experience in relevant area of expertise;
• Fluency in written and spoken Serbian. Fluency in English will be considered as an advantage.

Key Expert No. 3: Regulatory Officer (Independent Advisor) with:
• University degree in Law (Bachelor's degree or higher)
• Preferably five years or more of professional experience in relevant area of expertise;
• Fluency in written and spoken Serbian. Fluency in English will be considered as an advantage.

Key Expert No. 4: Professional Development Officer (Analyst-Advisor) with:
• University degree (Bachelor's degree or higher);
• Preferably three years or more of professional experience in relevant area of expertise;
• Fluency in written and spoken Serbian. Fluency in English will be considered as an advantage.

Non-key experts are expected to include:

Non-Key Expert No. 1: IT Support Officer (Administrative Officer) with:
• Degree in computer sciences or other related areas (Vocational school or higher);
• Preferably three years or more of professional experience in relevant area of expertise;
• Fluency in written and spoken Serbian. Fluency in English will be considered as an advantage.

Non-Key Expert No. 2: Administrative Officer  with:
• Associate degree or higher;
• Preferably three years or more of professional experience in relevant area of expertise;
• Fluency in written and spoken Serbian. Fluency in English will be considered as an advantage.

Submission Requirements:
In order to determine the capability and experience of Consultants seeking to be selected, the information submitted should include the following:

A. Technical Proposal

A1. Completed Consultant Declaration Form and Contact Sheet, the template for which is available from the following web-link:

A2. Company/group of firms' profile, organisation and staffing (max. 2-4 pages).

A3. Details of previous project experience or similar assignments particularly undertaken in the previous five years, including information on contract value, contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided (if different from duration) , main activities, objectives (max. 15 pages).

A4. CVs of key and non-key experts who could carry out the Assignment detailing qualifications, experience in similar assignments, particularly assignments undertaken in the previous five years, including information on contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided, assignment budget, main activities, objectives.

A5. Proposal for assignment implementation, including the proposed approach and methodology to a successful delivery of the Assignment, reporting format and structure, a work plan with milestones, and a Team Input summary indicating the number of working days allocated to the Assignment by each Key and Non-Key Expert (max. 15 pages).

Submission format:

A. Technical Proposal
The technical proposal shall be submitted in English and Serbian via email (pdf) to the Client's contact person, to reach the Client not later than the closing date. One additional electronic copy shall reach the Bank's contact person by the same due date. The technical proposal shall be one file (pdf).

The Client reserves the right to reject applications of firms submitting more than one file. Only if any limitation on the permissible file size is exceeded, the Consultant may split the technical proposal into further files.

Consultants are reminded that the technical proposal MUST NOT contain the financial proposal (the instructions for which are listed below).

B. Financial Proposal
The financial proposal shall be submitted in English and Serbian in a separate email to the Bank's contact person only, to reach the Bank not later than the closing date. The financial proposal shall be one file (pdf). 

Once the technical evaluation has been completed, the Bank will share the financial proposals of the eligible firms with the Client.

Important Notes:

1. This is a Selection from Shortlist procedure as envisaged in the EBRD's Procurement Policies & Rules. The selection will normally be made from responses to this notification only. The highest-ranked Consultant will be invited to negotiate the contract, subject to availability of funding.

2. Validity Period: The proposal validity period is 90 days from the deadline date for receipt of submissions. During this period, the Consultant shall maintain its original Proposal without any change, including the availability of the Key Experts, the proposed rates and the total price.

3. The award criteria and weightings will be as follows:

a) Firm's previous project experience in the successful provision of similar services in assignments of comparable nature, scale and complexity to those required under this Assignment (15%);
b) CV of Key Expert No. 1 (15%);
c) CV of Key Experts No. 2 - 4 (15%);
d) Quality of the Consultant's proposal for assignment implementation (25%);
e) Interview (10%); and
f) Financial Proposal (20%).

Interviews

All firms with a combined score of 50% or more of the total marks available for criteria 3(a) – 3(d) inclusive will be invited to interview (criterion 3(e)).

The Client will consult with the firms regarding the format (e.g. skype call, meeting, conference call, etc.) and date of the interview at the time of the invitation. The interview will be attended by all members of the Client's Evaluation Committee and all Key Experts nominated by the Consultant.

Please note that all and any costs incurred by the Consultant in connection with attendance to interviews will not reimbursed by either the Client or the Bank.

Evaluation of Financial Proposals

Only those submissions which score 60% or more of the total marks available for the technical criteria (a-e inclusive) will be eligible to have their financial proposals evaluated.

The lowest evaluated Financial Proposal (Fm) is given the maximum financial score (Sf) of 20. The formula for determining the financial scores (Sf) of all other Proposals is calculated as following:

Sf = 20 x Fm/F, in which 'Sf' is the financial score, 'Fm' is the lowest price, and 'F' the price of the proposal under consideration.

4. Written Questions and Clarifications: Applicants may submit the questions concerning this procurement notice in writing only via email to both the Client's and the Bank's contact persons listed above. The deadline for receipt of requests for clarifications/explanations is 23rd January, 2017 by 16:00 hours (Local Belgrade Time). No questions will be accepted after this date.
