Przedmiotem zamówienia jest sukcesywna dostawa chemii gospodarczej i specjalistycznej dla Katolickiego Uniwersytetu Lubelskiego Jana Pawła II. W zakresie przedmiotu zamówienia wymagana jest sprzedaż i dostawa wraz z wniesieniem przedmiotu zamówienia do pomieszczeń Katolickiego Uniwersytetu Lubelskiego Jana Pawła II, zlokalizowanych w Lublinie oraz w Stalowej Woli. Dostarczony przedmiot zamówienia musi być nowy, nieużywany, wolny od wad. Warunki wykonania zamówienia zawarte są we wzorze umowy, stanowiącym załącznik nr 3 do SIWZ. Szczegółowy opis przedmiotu zamówienia zawiera załącznik 1 do SIWZ. Zamawiający zastrzega, że ilości asortymentu podane w Specyfikacji Istotnych Warunków Zamówienia są ilościami szacunkowymi określonymi w celu ustalenia maksymalnej wartości zamówienia, cen jednostkowych, porównania ofert i wyboru najkorzystniejszej oferty. Zamawiający, zastrzega sobie prawo dokonywania przesunięć ilościowych towaru między pozycjami asortymentowymi zawartymi w Załączniku 1 do SIWZ, co nie ma wpływu na ceny jednostkowe. Z uwagi na to, iż podane ilości mogą ulec zmniejszeniu lub zwiększeniu, wynagrodzenie Wykonawcy będzie płatne wg. rzeczywistej ilości dostarczonego przedmiotu zamówienia. Wykonawcy nie przysługuje roszczenie o realizację dostawy w wielkościach podanych w Specyfikacji Istotnych Warunków Zamówienia. Jednocześnie Zamawiający oświadcza, iż zrealizuje zamówienia o wartości odpowiadającej nie mniej niż 60% i nie więcej niż 100% łącznej ceny brutto wskazanej w ofercie. Maksymalną wartość świadczenia do którego zobowiązany jest Wykonawca na rzecz Zamawiającego stanowić będzie wartość brutto zawartej umowy. Zamawiający wymaga by oferowane artykuły posiadały odpowiednie atesty, znaki jakości, a jeżeli są wymagane również Świadectwa Jakości Zdrowotnej PZH. Na żądanie Zamawiającego w ciągu 7 dni Wykonawca dostarczy wskazane dokumenty. Jakość dostarczonych towarów musi odpowiadać wymaganiom Polskich Norm lub innych norm branżowych. Zamawiający zobowiązuje się do zamawiania towarów nie częściej niż raz w tygodniu. Zamawiający złoży zamówienie według własnego zapotrzebowania za pośrednictwem faksu lub drogą e-mailową. Wykonawca jest zobowiązany zrealizować zamówienie w ciągu 3 dni roboczych od momentu złożenia zamówienia przez wyznaczonych pracowników Zamawiającego. Przez dni robocze rozumie się dni od poniedziałku do piątku. Wykonawca będzie zobowiązany do dostawy zamówionej partii przedmiotu zamówienia w dniach od poniedziałku do czwartku w godzinach 800-1500, w piątek w godzinach 800-1200 po uprzednim uzgodnieniu z upoważnionym pracownikiem Zamawiającego, na wskazany w zamówieniu adres. Towar będzie dostarczany zgodnie z zamówieniami szczegółowymi pod następujące adresy: Katolicki Uniwersytet Lubelski Jana Pawła II, Al. Racławickie 14, 20-950 Lublin Katolicki Uniwersytet Lubelski Jana Pawła II , ul. Konstantynów 1, 20-950 Lublin, Wydział Zamiejscowy KUL w Stalowej Woli, ul. Ofiar Katynia 6, 37-450 Stalowa Wola Wykonawca zobowiązany jest realizować dostawy transportem własnym, na swój koszt i ryzyko, na podstawie zgłoszeń dokonanych przez Katolicki Uniwersytet Lubelski Jana Pawła II poprzez osobę uprawnioną do kontaktu. Wykonawca zobowiązany będzie również do rozładunku i wniesienia dostarczonego towaru, w miejsce wyznaczone przez upoważnionych pracowników Zamawiającego. Wykonawca ponosi całkowitą odpowiedzialność za dostawę towaru i zobowiązany jest należycie zabezpieczyć towar na czas przewozu. Wykonawca zobowiązany jest do dostarczenia towarów będących przedmiotem zamówienia fabrycznie nowych, w opakowaniach zbiorczych z etykietą zawierającą nazwę handlową artykułu, ilość sztuk w opakowaniu oraz nazwę i adres producenta, przydatnych do użytku przez okres minimum 12 miesięcy od daty dostawy każdej partii zamawianych produktów, chyba ze w Opisie przedmiotu zamówienia wraz z wyceną wskazano inaczej. Dostarczone produkty mają być nowe, wolne od wad i spełniające wymagania określone w załączniku 1 do SIWZ. W przypadku stwierdzonych wad jakościowych lub w przypadku dostarczenia przedmiotu zamówienia innego niż był zatwierdzony przez Zamawiającego, informuje on Wykonawcę o stwierdzonej wadliwości, wstrzymując jednocześnie zapłatę za zakwestionowany towar i uruchomi postępowanie reklamacyjne. Po stwierdzeniu zasadności reklamacji Wykonawca zobowiązany jest dokonać wymiany towaru na wolny od wad, na własny koszt na przedmiot zamówienia opisany w załączniku 1 do SIWZ, w terminie 2 dni roboczych od dnia uznania pisemnej reklamacji. Termin na złożenie reklamacji wynosi 5 dni roboczych od dnia otrzymania przedmiotu zamówienia Zamawiający zastrzega sobie prawo do odmowy przyjęcia przedmiotu zamówienia dostarczonego w sposób niewłaściwy, w uszkodzonym opakowaniu lub w przypadku, gdy uszkodzony jest przedmiot zamówienia.
