In order to future proof the investment under this framework JSL is looking to procure hardware capable of providing an edge demarcation between the site and the Janet network. These devices need to form part of a unified solution capable of providing speeds from 1Gb/s through multiple 10Gb/s to 100Gb/s over the duration of the lifetime of the framework. Whilst a single device does not need to be in-life for all these stages a solution based upon a single family of devices is preferred to reduce operational complexity.

In addition a range of aggregation devices may be needed as part of the deployment in order more efficiently to utilise the services procured under Lot 1. Organisations tendering for Lot 2 should be aware that the current Janet6 core is built using a combination of Ciena and Juniper hardware and interoperability with these manufacturers' equipment is paramount.

II.2.11) Information about options Options: No II.2.13) Information about European Union funds The procurement is related to a project and/or programme financed by European Union funds: No Section IV: Procedure IV.1) Description IV.1.1) Type of procedure Negotiated procedure without publication of a contract notice Justification for selected award procedure: The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons Explanation: The Authority requires the integration of Sky Guardian 200-Digital (SG200-D), a replacement Radar Warning Receiver (RWR), onto the Chinook Fleet. The Authority intends to place a contract with Boeing Defence UK (BDUK) for the platform integration of the SG200-D onto Chinook Mk 5 (Lot 4), Mk6 (Lot 5) and Mk6A (Lot 1, 2, 3). BDUK will carry out integration, test and evaluation, and project management. It is anticipated that engineering and support work (consisting of design, certification and qualification) will be carried out by The Boeing Company Limited as a Sub-Contractor to BDUK. The Authority anticipates that the system integration of SG200-D will be subcontracted by BDUK to Leonardo MW Ltd (Airborne and Space Systems). It is considered that this Contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the EU Defence and Security Public Contract Regulations 2011) for technical reasons. The Boeing Company Limited are the original equipment manufacturers of the Chinook Aircraft and the appointed Design Organisation (DO) for the Chinook Aircraft in accordance with Regulatory Article 5101 Design Approved Organization Scheme (DAOS) approval procedures and responsibilities. The Authority believes that the integration, test and evaluation, and project management can only be carried out by BDUK and that the engineering and support work can only be carried out by The Boeing Company Limited. This is because The Boeing Company Limited hold relevant skills, technical data, drawing and design information, and are not prepared to share or licence the use of that information outside the Boeing group of companies (of which BDUK is part). The aforementioned skills, technical data, drawing and design information are necessary for the performance of those activities which will be carried out by BDUK and The Boeing Company. Furthermore, only BDUK hold the level of certification (under the Authority's Contractor Flying Approved Organisation Scheme) necessary to carry out flight trials of the modified mission systems. It is not possible for another company to obtain the relevant level of certification without access to the skills, knowledge and technical information that only The Boeing Company hold. It is anticipated that BDUK will sub contract the system integration of the SG200-D into the Chinook platform's existing Defensive Aid systems to Leonardo MW Ltd (Airborne and Space Systems). This activity consists of engineering work, testing, publications and training support. The Authority believes that this system integration can only be carried out by Leonardo MW Ltd as only they possess the technical know-how and hold relevant technical data, sub-system rigs, drawing and design information required for this activity. Leonardo MW Ltd are not prepared to licence the aforementioned information so as to enable a third party to carry out the work. These devices need to form part of a unified solution capable of providing speeds from 1 Gb/s through multiple 10 Gb/s to 100 Gb/s over the duration of the lifetime of the framework. Whilst a single device does not need to be in-life for all these stages a solution based upon a single family of devices is preferred to reduce operational complexity. In addition a range of aggregation devices may be needed as part of the deployment in order more efficiently to utilise the services procured under Lot 1. The PRC-112 is a handheld military radio with covert capability including GPS, UHF Satcom digital 2-way messaging and encryption. The contract extension will increase the budgetary level by 6 792 699.08 GBP (VAT ex). It is considered that the contract can be extended using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for reasons connected with the protection of exclusive rights. PRC-112 radios are ITAR controlled items and the OEM is General Dynamics, a US based company. The Company is ITAR approved, which is a mandatory requirement for General Dynamics in order to supply the Company. The Company is the only economic operator within the UK with a distribution license from the OEM. The OEM has issued distribution licenses to other companies outside the UK, however the PRC-112 radios contain classified (UK Eyes Only) information and therefore the Company is the only economic operator able to distribute PRC-112 within the UK. It is also considered that the contract can be extended using the negotiated procedure without prior publication of a contract notice pursuant to Article 28 (3)(a) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(b)(i) of the Defence and Security Public Contracts Regulations 2011). Obliging the MOD to procure an alternative radio from a manufacturer other than the Company would result in the radios having different technical characteristics, which would result in incompatibility between the purchased radios and the aircraft and result in disproportionate technical difficulties in the operation and maintenance of the existing radios. In addition integration and testing would be required to ensure that the radio frequency does not affect the ability of each aircraft. There is only one other radio on the market that can offer the same capability and will not cause integration issues with regards to its size and the need to fit in service life jackets, however this is not accessible to the Authority as the OEM will not issue for UK use. The ISDL architecture was originally conceived and implemented in the 1980's as part of Air Staff Requirement (ASR) 888 which provided for an Improved United Kingdom Air Defence Ground Environment (IUKADGE) Integrated Command and Control System (ICCS).It underwent significant upgrade and technical refresh activities in the 1990's and early 2000's in order to work with the replacement for ICCS, the United Kingdom (UK) Air Surveillance and Control System (ASACS) Command and Control System (UCCS) and its associated communications infrastructure. The ISDL equipment is used to connect UK ASACS main radio operating sites with their associated transmitter (Tx) and receiver (Rx) sites. The requirement is for a contract for the provision of support services for ISDL until 31.3.2022.
