The initial part of the appointment is to produce an Architectural feasibility study following the production of an options appraisal arising out of liaison with the CYC management team and key stakeholders. The fee for this element of the design will be established by the submission of a resourced activity schedule. Selection of the consultant for the commission will also be based on a quality assessment details of which follow in later sections of this document. The second part of the appointment should the project advance to delivery stage will include for a multidisciplinary design team to design and deliver a bespoke disabled children's short breaks provision care facility including complex health and autism care in York, to include the following principle roles and associated management of other specialist contributing to the design, the fee for this element of the design will be established by the submission of a percentage fee rate to be applied to the final construction value which is expected to be around £2.5m. The University has a requirement for a new, purpose-built centre to house an International Pathway Programme (sometimes known as an International Foundation Programme). The University's original partner (a commercial entity specialising in setting up and running foundation programmes) had commissioned architectural designs and drawings for a unique building, specifically designed for the purposes of housing a foundation programme on a particular University site. These designs/drawings were produced, without University funding, to an enhanced RIBA Stage 2 and used to obtain planning permission for this building. Subsequently, the University decided not to proceed with the original partner and is now looking to establish a pathway programme in its own right. Accordingly, the University plans to purchase the designs/drawings from its original partner. In view of the original partner's exclusive rights in these designs/drawings via its contracted architects, the University does not plan to commence a competitive process for this purchase. The University does not believe that a new design competition could be fairly tendered given the existence of designs/drawings which are acceptable to the University and the local planning authorities and which can be purchased by the University on favourable terms (they have limited value for any other purpose). The University wishes to state that this is an exceptional use of the Negotiated Procedure without prior publication of a Contract Notice and that it fully intends to compete forthcoming opportunities for architectural designs.
